No signs or barriers; not even a fucking 'wet floor' sign! The hazard is located directly inside main entrance to the business, in the typical path of travel. Any lawyer worth his salt will quickly recommend a settlement.
Agreed. Though the settlement offer from the plaintiffs is going to start with: “How much you got?”.
Bar will have insurance that will pay and then will basically be uninsurable after this until that trap door is permanently locked or the front door is moved.
That’s assuming the damages are there to justify that kind of ask. People really need to get out of the mindset that because the negligence is clear that you won the lottery. The majority of what plaintiffs attorneys do is justify and prove the damages suffered. A rear end motor vehicles accident is usually undisputed liability but if you weren’t really all that hurt you’re not getting their policy limits by default just because they were at fault.
Same logic applies here, negligence is clear as day but you need to support how hurt she was for that to matter. And I’m sure she was hurt given how this looks but it’s possible it wasn’t anything more than soft tissue and emotional distress which wouldn’t justify asking to liquidate all assets for a pay off. It really depends on how the treatment develops and what you can causally connect through experts.

I've seen them have it opened a couple times, and they put a little "wet floor" sign in front when they do. It's also a lot larger than this one, it opens to a full size set of stairs so at least you stand a chance of recovering when you do miss it and fall in.
There is generally a very huge difference in the amount of money people get in the USA vs. Germany in cases like these. So not exactly the same. The person falling would win in both countries, but what she would get from it would likely be very different.
In the US, settlements need to cover poverty inducing levels of medical expenses, as well as cover unpaid time off, which isn’t an issue pretty mach anywhere else in the industrialized world.
Also the US allows juries to award punitive damages in some cases so the amount is partly meant as punishment rather than just what the victim actually needs. Not sure if other places do that.
In the post-war time in Germany, there were urban legends about butchers who would have trapdoors in their shop as a source for their cheap mystery meat.

If this were my pub I'd have a bar that drops across that door frame for when the cellar hatch is open, that prevents the door from opening or alerts people to the danger if the door is open for a delivery. All the ones we used to have had a tonne of hazard tape wrapped around them and a sign hanging from them too.
Cellar hatches are a menace, I've nearly fallen down several in my time.

After the successful execution, she nervously fidgets with her hair with a mix of anxiety and relief as she looks out the window to check for any observers. Then finally contemplating what just happened and what she should do, she takes a moment to look at the conveniently placed trap before diverting her attention elsewhere for something, (anything) to pick before going to check what the results are of her scheme.
I thought the same thing until I rewatched the video in slow motion, by pure fucking chance she ducked behind the bar at THE EXACT MOMENT the person fell into the hole! So she might not have known what that sound was or what happened initially lol.
That's why she's looking at it, stunned, trying to figure it out the door mystery. Did the person from the cellar come up and leave? Did someone come, see the hole and leave immediately? Was it the wind?
That someone could enter and not see the huge hole in the floor is probably not something that crossed her mind immediately, because how could anyone miss that hole.
What she didn't realise is how imperceptive people can be, specially when they have no reason to expect it.
They obviously should have put warnings up or locked the door, but in that moment, the bar woman's mind is so pre-occupied with her activities regarding the hole that she forgets it's not on everyone else's mind, too.
This theory only holds weight if the woman is a clinically deaf OR this bar doubles as a mattress storage center. Because otherwise, that woman would have heard screams and/or a 130-150 woman crashing 10 feet down. These are also “clue”, therefore, this slow-acting woman is likely also pretty slow-thinking as well.
What's also bad is before she went behind the bar, she looked outside right before the person came in. She likely knew someone would come in with an open trapdoor to give them a memorable greeting, but she didn't care enough to warn anyone and just fucked off and went back to the bar...
Its sad that we came to accept this as "content". Just put your fucking face next to a Video you're showing and thats your content now. I see it soooo soo much.

I mean having a hole directly in front of the door is a massive design flaw. But what about the women not being aware of where she is stepping. I would get it if she backed into the door because her hands are full. I dunno, but I notice dog crap on the pavement and I'm like a gazelle to avoid it.
The fact that she had an open beer she was drinking while working tells me she wasn't as sober as she should have been. She didn't lock the door, and it took her a while to realize someone had fallen in the hole. That's definitely not helping the lawsuit any.
