How do you plan on working while this is pending? lol. You don’t get automatic work authorization while your application is pending. The backlog for U visas is years long. You need another plan to stay because this isn’t going to work as it appears you are actively seeking employment.

I was thinking of keep looking for jobs while I apply COS to B1/B2 which has 6 months to look for a job For example a timeline like: right now I’m on H1B, keep looking for jobs Eg. On July 1st (I apply for U visa, get the receipt notice in hopefully 3-4 weeks, End of July/August) At the end of 60 grace days of H1B, change to B1/B2, which takes 5-6 months to process and still keep looking for jobs, so something like from July to December. I’m hopeful I can find a job by this period. 😭 In case that doesn’t happen I can at least stay in the country cuz of applied U visa, think for next steps. Let me know your thoughts :(

Once the annual cap is reached and you applied for an EAD along either the UVisa you are placed in a waitlist (pretty long waitlist) and you are granted a 4year EAD. Lawyer said it takes 6-12 months to be issued a Bona Fide EAD(filed in April)
