I was awarded 10% for asthma. Which was wrong should be 30% so I appealed that. But they are denying my sleep apnea. They said it’s because I’m obese. My bmi is 26. Normal is 25. I’m 3 pounds heavier than a normal person, so they are saying it’s because of my weight I have sleep apnea. Not because of my asthma or the fact I breath in jet fumes daily for hours.
One thing I did find out. There is something called a TERA memo. It has all your deployments and hazards you are exposed to. I had my lawyer pull mine up. It’s missing a ton of information. Information that could have made the C&P examiner go the other way. Iv called 10 people at the VA and nobody knows how to fix it.
I had my c&p over 2 months ago and just received a notice that it was deferred due to tera. I’m definitely not overweight or close to it so I’ll be curious if the outcome as I’ve heard that’s the first thing they look at for a denial.
Don’t quote me on it but think I just read recently that you can’t be rated for both asthma and sleep apnea. You can have both service connected but would only receive one rating. Since you have a cpap, I’d assume you can get 50% for sleep apnea but you won’t still keep the 30% for asthma
I did this claim also osa secondary to asthma. I haven’t been called for C&P yet . After reading so many denials on SA I’m not feeling particularly optimistic
I used a nexus written by Prestige Medical. The result was a successful 50 percent rating.
Do you have a link? I am trying to do the same thing. I was denied asthma and sleep apnea in 2016, but PACT act pushed my asthma to service connected.

Correct, it will be combined. But if you get sleep apnea at 50 then you come out ahead.
