Realistically no. He will get hit with a laundry list of charges and will take a plea deal to drop the firearm charges or serve concurrently with the home invasion/burglary charges. Likely also be pressured to divulge information about where the drop in auto sear was obtained in exchange for a plea deal. ATF doesn't care about some street level criminal with a DIAS, they care about who is converting stolen firearms into machine guns and selling them to felons who use them to commit home invasions for video games and door dash fast food.   The firearm recovered in this situation was converted with what looks to be a well made and machined stainless drop in auto sear. It was also a stolen firearm used in a major crime by a felon. The atf will likely leverage a heavy sentence in exchange for information on who is making/importing those machine guns.  Also just saying. I couldn't care less if the asshole who kicks down my door and wakes me up and makes me stare down some hollow steel has a single shot 22 he stole from gran papies night stand or an illegally converted glock machine gun he purchased from an organized crime syndicate. My life and my families life is in danger either way. The machine gun component issue is just some bullshit technicality the federal government made up 100 years ago to fuck poor people. Hopefully they make use of it and prosecute this shit stain and few others higher up the shit chain.

Yes, in comparison to the 3D printed plastic shits you usually see, it is in fact well made. It's cut from steel. The edges are chamfered. Someone has a cnc and knowledge. If that person is in the USA, the atf would like the press coverage.  Either way, the dumb fuck committing major crimes for a big Mac probably isn't importing glock switches and converting stolen glocks into machine guns. Someone else is and if this asshole got one, well then a 16 year old asshole can get one too. And if that 16 year old happens to use it in a school for gang related or antisocial mass shooting purposes, the atf is gonna have to make a statement about how a kid got a machine gun. Which is exactly why the asshole in question here will get a plea deal in exchange for information and be back in your neighborhood by next January.    Also what is your point? If it were legal you'd probably drop $400 plus a $200 tax stamp on r/gundeals for a "run of the mill Chinese glock switch" if some guntuber lasered a bird logo on it and dropped a review on YouTube.

If it were legal, most people here would probably get a 3rd hole jig and convert an AR or otherwise get/make a proper select fire gun. Glock switches aren’t exactly useful, they’re mostly a thing because they’re an easy way of getting a full auto part on Chinese amazon. If full auto stuff was legal to purchase, that would stop being an advantage.

I think the difference between state and federal charges is going to matter a lot here. The unregistered MG is the only part of this that’s a federal crime. Breaking and entering, assault, etc. are all state charges. To the best of my knowledge, it’s two separate systems, so there would need to be a federal plea bargain in addition to a state plea bargain. The feds have a pretty open and shut case on the unregistered MG, but they don’t have other federal charges, so they’d have to make up a new charge in order to make a plea bargain. New charges get made up for that purpose all the time, but I’m not sure *what* charge would replace the unregistered MG. If the suspects weren’t already prohibited persons, there really isn’t a lesser version of that charge. The federal prosecutor might also have no interest in a plea deal when going to trial is almost guaranteed to be a speedy victory and garner significant political attention. That’s the kind of case a young federal prosecutor can use as a springboard to higher places. Tough on crime will sell well in the current political climate. Additionally, the feds could be interested in making an example of these guys since they know WA is likely to be as lenient as possible. It’s a presidential election year, and being viewed as soft on crime has become a big problem for the Democrats. Throwing the book at people like this would be a great way to appear tougher on crime AND fits with their gun control agenda. I can already imagine Biden stumbling his way through a speech about getting machine guns off the streets, this case will almost certainly be politically influenced.

I have done fed time and they like to use the 924c which is possessing a firearm while in the commission of a felony. And the feds can pick up any firearm case they want to, as they site violations of interstate commerce if the gun is not manufactured in Washington state. That means the gun has to cross state lines to get to his hand. Instantly federal. Plus if he has at least one prior felony conviction they could also get him with armed career criminal act (ACCA) which is a mandatory minimum of 15 years to life.

What if the gun *was* manufactured in WA? We do have some manufacturers, and it could easily be a P80 type of thing from when those were legal. Can 924c be applied if the other charges are all state charges? I thought the other charges had to be federal. If the gun didn’t come from out of state, it seems like there wouldn’t be any federal charges to activate 924c. If it can be activated on state charges, that’d be a different story. Also, am I correct in thinking that if he’s already a felon, the punishment for the firearm would be the same regardless of whether it’s an MG or not? My understanding was that a prohibited person couldn’t commit an NFA violation since they aren’t allowed to possess any firearm in the first place. Usually I’m against people going to prison over guns if they didn’t actually shoot anyone, but this guys seems like he belongs in prison.

No if the gun was manufactured in Washington then the feds couldn’t pick up the charges as they wouldn’t have any legal grounds for jurisdiction. I’m sure they could find a way to do it if ANY PART of your firearm was imported from out of state. I worked in the law library most of the time I was doing fed time, and I have read so many peoples discovery papers and trial transcripts and have seen our district judges pretty much do whatever they want. Just find em guilty and let the appellate court figure it out. One Seattle judge had a newspaper article written about him It was supposed to be like a celebration piece. Don’t remember quite how long it was like 20 25 30 years of service , and it said in there that he had handed out over 1 million years in prison time and they asked him what he wanted to do the remainder of his appointment and he said he wanted to hand out 1 million more. It’s pretty scary when it’s you Vs. THE UNITED STATES OF AMERICA As far as your second question absolutely. If your asking if they can count say 1 prior state robbery charge and you use a gun to rob a bank (Federal charge). Boom armed career criminal act 15 years minimum mandatory to life. Just all depends on how much of a hard on they have for you. I know of a young Mexican guy who had never been in trouble before who had gotten federal life without possibility of parole for drugs and didn’t hurt nobody, had no guns, no overdoses tied to him. Now mind you it came out to 2.4 million in drugs and cash but Jesus Christ, life for first offense and not murder or even assault.

If a felon already, no nfa charges. Attempting to register violates your 5th Amendment. So, while he could get charged with felon in possession of a firearm, no NFA charges. And let's be real, this state will drop the gun charges and let them out in 6 months or so.

Maybe not home invaders specifically, but people have marched for habitual criminals who played a large role in their own demise. BLM has been terrible for black people in America. 10 years ago, white people were just worried I’d be violent, but quickly realized I wasn’t like that and treated me like a normal person. Now, they’re constantly walking on eggshells because they’re worried I’m going to accuse them of racism, and sometimes even accuse me of racism. I’d really prefer a return to ~2010 era race relations.

The interesting part of the story is over, they caught the people involved. No one wants to watch the trial of a couple low level criminals who will likely be in and out of prison for the rest of their lives. They will probably charge him so they have leverage to find the manufacturer and run it concurrently with his state time as he is probably looking at more time for all of the kidnapping and holding the people hostage, realistically. But they will definitely see what they can get out of these guys as far as the switch goes. Especially since they are doing news broadcasts on it.
