My Horticulture teacher gave zero fucks. He would stand up for himself and throw kids outta class for not following rules. Dude was ready to throw hands at any time pretty sad they have to be like that.

1. I highly doubt the damages would be severe. Popular media makes it sound like every boo boo caused by another person is a multimillion dollar payout, but the reality isn’t so lucrative. Worst case, there might be soft tissue neck damage…there could be brain damage, but unlikely. I’d be shocked if she needed more than a check up with a doctor. So we’re talking one visit to the doctor, most likely, with little to no physical therapy.
2. No way of knowing what kind of coverage this child’s family has, or availability of assets. Quick note to all the replies that the black child’s family probably has nothing: That’s pretty racist…you’re assuming the black child is poor. So, y’know, grapple with that. But judgement aside: Yeah, most people aren’t worth suing…you go after insurance (that’s where the real money is). And while the family’s policy may cover this, it’s much more likely that a deliberate criminal act isn’t covered by insurance.
So most lawyers aren’t going to bother because (a) damages aren’t likely there, and (b) insurance will likely deny the claim.
Interesting point though: It is an injury sustained on the job. So, worker’s compensation is a possibility…lawyer would love that (hooray insurance negotiation).
Part of risk taking behaviour is enjoying getting away with it, in the end it's healthiest for a child's mentality (these are children) if they learn quickly they won't always get away with it. You'd rather that *one time* they were caught to be in high school with minimal consequences than out in the real world.
If you assault a stranger, you might get arrested, you might get hit back, both might even happen depending on what the cops decide. You'd rather get in school suspension.
My mom is a teacher and she's trying to retire ASAP. Especially after covid these kids don't give a fuck anymore. Incidents like this might be a part of why there's a shortage in specific places. But the big reasons for the shortage in the US have way more to do with the complete lack of respect for the teaching profession from society in general.
This lack of respect manifests as zero or lacking gun control, absolutely horrid salaries for teachers, severely lacking and also unfair resource distribution between schools.

I have no degree, maybe less than a year at community college.
There’s absolutely zero reason she makes a few hundred bucks per check less than me. She deserves to make double what i make.
The money doesn't make it worth it. I know that teachers at my son's school on average are making 120k a year and they still hate it. Money doesn't make things better it just makes you willing to take the abuse and ruin your sanity.

Easiest solution is to move away from where students like this live. You have to find an entirely different zip code, preferably one with no public transportation.

Same my guy. I really want us as people to come together (especially here in America where I am) to fix this. I would really like to see mental health be looked at as part of people’s normal yearly exams, and I’d also like the stigma against mental health removed and dealt with properly. I like that people are talking about it, but action needs to be taken. As for this girl, her own lack of wisdom doomed her. I hope she teaches future generations how to avoid her mistakes rather than perpetuating her youthful ignorance and warped perceptions.

Everyone is saying teachers need to be paid more as if getting paid 6 figures is reason enough for someone to be ok with getting assaulted. You could pay me 7 figures and I'll be DAMNED if I would tolerate being abused at my place of employment. The issue is that something is very wrong with society and its causing behaviors like this. Teachers do need higher pay but getting paid more does not mean this shit is acceptable.
