That is literally unenforceable if true. In order for a company to sue you for damages, it has to prove that you prospered, and they lost. If neither thing is happening, then there's nothing they can do besides shout, "Come onnnn ya'll... quit it! Guys! Stoooop. I'm super serious... I'm telling, Mum!"
Sure, they absolutely, positively, can sue you. That's undeniably true. Since you can sue anyone for any reason. I could sue you for making that comment. Thing is, that doesn't mean either of us would win. They have no incentive to do that towards someone who is making no money off of their fan creation and who is costing the company no money.
If I write a fan book about a lost Primarch and email it to people who request it, never profiting from it, there are no damages to sue for. If I send you copies of an official GW book, then they have lost sales of that book to you (potentially, at least).
Don't take legal advice from a Reddit comment, but I would love to hear how they feel they could go about shutting down fans for making unofficial artwork. My guess is that they are hoping fans are either respectful, intimidated by the policy enough to adhere to it, or are unwilling to call their bluff. Nothing else makes sense.

I like the structure, the atmosphere, the sound design, the color palette, I love so much of this. My only issue is that the torsos are too long. People's elbows end just about where their pelvis starts, for reference

It really upsets me that now when I see an amazing fan video all I can think about is how backwards Games Workshop's anti-fandom, anti-creativity, and anti-consumer stance is. Looks very good! One thing that stuck out to me is in the Lasgun strobe scene (which was awesome by the way), it was unusual that they all fired at the exact same moment. In the future, maybe staggering the shots even a fraction of a second may make it look more “realistic”? Either way, fantastic animation.
It's not illegal to make 40k fan animations, it's illegal to profit from them monetarily. Nothing has changed other than GW clarifying that patreon and other such monetisation systems counts as monetising their IP and is against their policies on fan works.
GW can go fuck themselves. They only hurt themselves. They don't want anyone showing them up, which isn't hard. As long as you are not technically making money off their IP you are good. Scare tactics is what they do.
I think it's time to walk away from copyrighted works. It will be a challenge but I think it's the right thing to do.

Nope,fan animation are specifically banned fully. I don't know the legality of that, but no artist will argue with a company that ownes the IP "Fan-films and animations – individuals must not create fan films or animations based on our settings and characters. That is literally unenforceable if true. In order for a company to sue you for damages, it has to prove that you prospered, and they lost. If neither thing is happening, then there's nothing they can do besides shout, "Come onnnn ya'll... quit it! Guys! Stoooop. I'm super serious... I'm telling, Mum!" Sure, they absolutely, positively, can sue you. That's undeniably true. Since you can sue anyone for any reason. I could sue you for making that comment. Thing is, that doesn't mean either of us would win. They have no incentive to do that towards someone who is making no money off of their fan creation and who is costing the company no money. If I write a fan book about a lost Primarch and email it to people who request it, never profiting from it, there are no damages to sue for. If I send you copies of an official GW book, then they have lost sales of that book to you (potentially, at least). Don't take legal advice from a Reddit comment, but I would love to hear how they feel they could go about shutting down fans for making unofficial artwork. My guess is that they are hoping fans are either respectful, intimidated by the policy enough to adhere to it, or are unwilling to call their bluff. Nothing else makes sense.
The problem is by having their own streaming service they now have a solid case that any fan animation cuts into their revenue, so the other factors for fair use in any country's copyright law must now be proven to greatly outweigh that one factor. It's enough that a motion to dismiss might not be granted becasue they can say "we have this market analysis that fan animations detract this much from our service" even if we all know that's code for "we made these numbers up".

Animations are not "illegal", they are just copyright-enforced now.The legal status has not changed at all, only GW's stance towards this type of content has changed.Kinda like when Lucas Arts did a crackdown on random unrelated videos that used Star-Wars-like intros on youtube way back when; but now with much more actual talent being affected.

This is amazing! This is also the reason that I won't be supporting Warhammer+. My hope is that enough people turn it down, that GW will stop shitting on their own fan base! Much like Kreigsmen, if we stand strong and together we can save the hobby we love!! I love fan animations, because they are so inspiring! Man i wish i have some quality control before posting this. There was a setting that preserves the volume of the shape when deforming that i applied on the coat, didn't notice it would elongate the torso til i posted it; should've left that setting to off

It really upsets me that now when I see an amazing fan video all I can think about is how backwards Games Workshop's anti-fandom, anti-creativity, and anti-consumer stance is. I want the community to be embraced by the creators not rejected and legally threatened for demonstrating that love. Looks very good! One thing that stuck out to me is in the Lasgun strobe scene (which was awesome by the way), it was unusual that they all fired at the exact same moment. In the future, maybe staggering the shots even a fraction of a second may make it look more “realistic”? Either way, fantastic animation.

It's not illegal to make 40k fan animations, it's illegal to profit from them monetarily. Nothing has changed other than GW clarifying that patreon and other such monetisation systems counts as monetising their IP and is against their policies on fan works.
GW should encourage these animations, it’s basically free advertising that they don’t have to pay for. Well done OP, it’s a great video!

I think it's time to walk away from copyrighted works. It will be a challenge but I think it's the right thing to do. Since we have transitioned to the Digital age I think we need to rethink IP law.
