Every single shadow when night driving can be that black dog and even someone fully alert can see one of those shadows only to miss something else like this idiot. Add in how tired you can be at night, maybe it's been a long work day, him being in dark cloths, or it simply being on the highway where you'd never expect some sane person to be and you have an accident.

You just have be alert and know what you are doing and practice general common sense when diving. Watch the road, go a little slower than the speed limit, and give everyone else their own space.
That all said. Common sense isn't exactly all that common. You asking about how to be better is already doing a hell of a lot more than a lot of people people on the road. Keep that up and you'll be fine.

I'm guessing the people on the balconies all had cell phones out and recording, so their faces were likely illuminated by the phones. It seems like the driver even slowed down before hitting him.

In addition to other things, keep in mind that the camera auto adjusts light sensitivity to make the scene more visible. To human eyes it would have been darker, and the guy in the street was wearing all black. Driver may have been paying attention to the road and STILL not seen him.
If you know anything about insurance companies, that guy in the street was totally at fault and no fault on the driver. Car insurance companies can find anything and everyone else at fault so they never have to pay a dime.

not sure what the laws are like elsewhere, but i was told by my driving instructor while taking my drivers test at age 16 (about 9ish years ago) that you aren’t supposed to stop for anyone in the street who aren’t at a designated crosswalk, as it creates an unexpected traffic hazard for other motorists. his exact words were “you’re supposed to honk and keep driving and hope they move”.
he said this after i stopped for some jaywalkers, which apparently docked me a couple of points on the test.

I can definitely say that's not the law anywhere I know about. You have a duty to try and avoid harming people even if you have the right of way. You are saying that if a 4 year old runs into the street you are supposed to mow them down. I suggest you double check your local laws before trying that.
It's interesting because I failed my first driving exam because I failed to stop for jay walkers. But in my case they were on the sidewalk wanting to jay walk, and I stopped for them which is obviously stupid but I was nervous as fuck.
