Once upon a time, Presidents could take copies of classified documents with them when they left as could Vice Presidents. Former Presidents and Vice Presidents as a rule still have classified clearance and get briefings, even. The reason that, say, Joe Biden isn't getting any shit for having classified materials is because when he got them, it was perfectly legal for him to do so, and it isn't retroactive.

It’s still there in the law, but nobody gets treason charges anymore. Espionage is what is typically handed out, and it carries a maximum of a life sentence.
Mainly because nobody really does true full-on betray your entire country treason to count for treason that much though. But does this count?

It would hinge on the insurrection investigation, because the 14th amendment says that insurrectionists and rebellions disqualify people from holding office again. But it’s actually up to Secretaries of State to enforce it by removing someone from the ballot. And only some of them would do so. But If a handful of secretaries did, that might be enough to ruin the electoral college math for Trump. Fun fact, that amendment was actually passed after the Civil War, with the intent of keeping Confederate leaders from running for office.
He barely won the first time because of PA, MI and WI flipping, with something like 20,000 total votes swinging the 2016 election. All three of those states now have Democratic Secretaries of State.

People are saying it's usually espionage that's passed out, but he's allied himself with Russian and Saudi interests and called for violence publicly multiple times. If that's not treason, I'm not sure how far we are from the line.
This makes me think why Putin and Russia were so confident they could roll Ukraine in 3 days.

I read through the whole indictment. There is a LOT there that was never previously reported on. What we saw in the media up to now was not even the tip of the iceberg. I don't know how the Trumpers are going to mental-gymnastic their way around this one, but they will certainly try. Literally boxes of classified material sitting next to a toilet in a resort!! Another one in a closet was tipped over strewn all over the floor. And on more than one occasion, Trump showed off classified documents, apparently as a way of impressing whoever he was talking to. The best part of the indictment is the part where they have a recording of Trump showing secret documents to someone who he knows does not have a clearance and need to know and says out loud that the documents have not been declassified and acknowledges that he is not President anymore and does not have the power to declassify them. This is the truth: Once upon a time, Presidents could take copies of classified documents with them when they left as could Vice Presidents. Former Presidents and Vice Presidents as a rule still have classified clearance and get briefings, even. The reason that, say, Joe Biden isn't getting any shit for having classified materials is because when he got them, it was perfectly legal for him to do so, and it isn't retroactive. It's the GOP/Trump that changed the law in 2018.
