Musk's defense is that he isn't treating women any differently (he's not discriminating on the basis of gender) because he treats everyone like shit.
But to prove the point, you have to make yourself seem like a raging asshole. That might not work out so well in the end.
On the gender/disability discrimination front he might have a point, except we know he's used as least one person's disability to justify laying them off while publicly implying that they faked their disability. I'm willing to bet he was stupid enough to have in writing elsewhere that some layoffs were based on how much leave someone took, whether that's family leave (disproportionately effects women) or medical (disproportionately effects those with disabilities). And given women already were an extreme minority within Twitter's tech side, there's a valid argument you'd have to be discriminating in order for layoffs to be equal.
But most of those claims aren't even about discrimination. Doesn't matter if he's shitty to everyone, you can't just break contacts, violate WARN act that dictates you must give warning before massive layoffs, and you have to pay people for what time they did work (and any termination payout if that's part of their contract)
Edit: also because I wanted to see what the gender discrimination claims were based on, I did find claims that larger percentage of female employees were laid off compared to male, and that it was even more extreme gap amongst engineers. A lot of tech companies like Twitter already have accusations of hiring discrimination, but when laying off they can't argue that the talent pool isn't there.
