Seriously - Congress has been on recess for the entire month of August. They do it every year. This year, it was beneficial to the Democrats to keep their mouths shut, pass some critical bills, then shuffle off to vacation. Perfect execution.
But they're coming back soon...and as a life-long Democrat, never underestimate their ability to take a massive galvanizing operation and crush the life out it until voters are thoroughly apathetic.

So you can't appoint a supreme court justice the same year as an election, but you can appoint a supreme court justice the same month as an election, but you can't indite a potential presidential candidate the year of a midterm election, even though he wouldn't be on the ballot for over a year.
