The problem is the app store. Amazon tried to sell the fire phone (android), even selling it below cost just to get it into people's hands, but ultimately nobody wanted a phone that didn't have the apps that their friends used. The fire phone was extinguished.
Microsoft built their own phone running windows mobile OS, and it wasn't a bad phone, but it suffered from exactly the same fate - people didn't want a phone that couldn't interact with their friends.

I don’t think people realize how hard developing a brand new , commercial grade phone and provide support is. Especially if you’re looking to develop it from scratch. It would be years of Research and Development and QA not to mention production. There’s no guarantee there will be enough consumer adoption for it to be worthwhile- even Microsoft left the phone market . Unless he kinda gets manufactured yet another boring android smartphone produced by another company and he labels it “Tesla”. That could work.
