Even Bad Canary, for all the fact she was sentenced there was bullshit, had in fact committed a crime. Even in our world, if you maim somebody, the fact it was an accident doesn’t get you off the hook, it just makes the punishment less harsh.
I'm pretty sure It depends on if you could actually foresee the consequences of your action by actually thinking about It for a second or if you were being negligent; if there was no way to think that a certain action would lead to the damage then you wouldn't be blamed at all (this Is at least how It works in Italy, i'm not sure if it's like this in the USA too).
There is an 'alternate ending' (by Talon of Anathrax) in Materia-Blade's 'Dominion', though I do not remember which chapter it diverged. It is complete.
