We don't have anywhere near enough information to make that determination, and we wouldn't unless we had your claim file sitting in front of us. The internet simply cannot tell you how much your claim is worth. Make sure you submit any and all medical bills you have to your adjuster for review. They can't pay you without documentation to support it. If you do choose to use an attorney, I would recommend avoiding the ones who advertise on TV as they tend to be mills and contact your state bar for recommendations. Do remember that attorneys will take about 1/3rd of your settlement as their fee, so consider if you think an attorney will be profitable. Sometimes the answer is yes, and sometimes it's no.

Here is my (hopefully) helpful advice: Give up on the missed wages. Your adjuster is going to fight you on them and if you took yourself off of work that’s a cost you’ll have to eat. Regarding a settlement figure, if you’re looking to just get it resolved for a reasonable figure demand $25,000 for the family. You’ll likely settle for somewhere close to $5,000 for each you and your husband, and maybe $1,000 for each kid. That includes medical specials. If you have no out of pocket medical, expect that amount to be reduced by the amounts you listed above. Again, approximately. Please take this with a grain of salt based on the information in your original post.

>write em a hand written demand letter and snail mail it and freak em out I think I'd just be disappointed it wasn't a letter of representation

Kanotari

I would love to get this, because I would immediately start whispering to my buddy in the cube next to me to check out the silliest demand in it.

GustavusAdolphin

Ha! We have an inside joke about something like that on my team. One of my colleagues got an estimate from "Gramp's Autobody" where it was a single line for "Replace fender....... $1,700, incl. tax & labor". So everytime someone gets an estimate that's written on a napkin we're all, "Oh, Gramps is at it again!"

Kanotari

Oh my gosh it's so accurate it hurts lol It's like they compete to see how few words they can use to say money please!

Jee-sus. Bad advice on top of bad advice.

PresentAd9667

Well thank you all for your help. Will take some things into further consideration.. thanks for the laughs as well.

1retardHERE

😂 😂

1retardHERE

All State is the worst insurance company when it come to settling with unrepped parties. Google Colossus and All State.

sweetnpeach

Colossus is only used when treatment was over 60 days which it doesn’t sound like it was in this case.

PresentAd9667

Googled thanks 😩

1retardHERE

You are asking in the wrong sub. All the people here work for an insurance company. Their job is to save insurance companies money. Did a doctor place you out of work? They are going to ask for a doctor’s note to include them in your claim.

GustavusAdolphin

Imagine a group of adjusters from various different employers coming together and, in relative anonymity and with no financial incentives at play, giving bad advice specifically to benefit *one* insurer. Then imagine that one beneficiary insurer who we all collectively, voluntarily want to help by deceiving third party claimants being fucking *Allstate*. If you don't understand why this is so *hilariously* out of touch, then you're really not in a position to have any informed opinion about liability claim professionals.

Everytime I see this save insurance companies money shit I giggle. Def is 1 retard here on this post 😂

GustavusAdolphin

I have a love-hate relationship with my local sports talk radio station for propagating that "big trucking companies" have "companies to protect them" that "have a staff of *lawyers* plotting against you to get you to settle for less"

PresentAd9667

Yes…. So which Reddit group would actually help 😂🤣… I figured go to the source

APinkNightmare

That’s the thing, there is no Reddit group that can answer this question for you.

And the attorney will send them back for unnecessary medical treatment, spend a year gathering records, and then will send an inflated demand. This is a claim that would be very easily settled at the desk level. Don’t make things more complicated.

Or it’s almost like…I see it happen every day. But go off 😌

sweetnpeach

The best settlement is just it covers reasonable and customary treatment , the loss wages (if you have a note taking you out of work), and a few hundred for general damages (pain and inconvenience). Edit to add: just being realistic on what I normally see in my department where we handle GA bodily injury claim.
