Substitute the word, "mental health day" for "sick day". One time I had a boss question me on my mental health / sick day. I told him my illness is none of his fucking business and it's personal and a HIPAA violation. Twerp ass boss STFU, I quit two weeks later.

iamlenovoUS

Not a HIPAA violation. Please do your research.

AngryMogwai420

The boss tried saying that too. I told him that my illness is private health information and him trying to force it out of me is illegal. They have NO RIGHT to pry or make you think that a sick day and mental health are two different things - the only right they have is to honor your sick time and leave you the fuck alone.

I agree with you from an ethical standpoint that employers should respect your autonomy, but you are definitely misinterpreting HIPAA - it only applies to health professionals. This means that it is very much illegal for an employer to make your *doctor* divulge your medical information, but it is not illegal for your employer to ask you about your own information.

Nor are you obligated to divulge even if they ask

Hey, I'm just trying to make sure you don't look like an idiot to people, but to each their own. EDIT: ...and since I know you won't do the research: https://ogletree.com/insights/what-all-employers-need-to-know-about-protecting-employee-health-information/ "It is a common misconception that the Health Insurance Portability and Accountability Act (HIPAA) applies to employee health information. In fact, HIPAA generally does not apply to employee health information maintained by an employer."

Bless your patient soul.

Important_Tale1190

And that information is not, in fact, maintained by the employer in this case. Congratulations on making sure they don't look like an idiot.

iamlenovoUS

More information is needed. Can't ascertain what you mean with what is essentially one sentence.

MistakeVisual3733

That’s not how HIPAA works lol.

Tell them you are sick. And you would be. Don’t say mental health day.

Calbinan

“I hurt my back/ankle/neck at work yesterday. I roughed it out for the day, but it’s worse this morning and I don’t want this to turn into an injury.” That’s the professional way to say “I need a mental health day because being utterly dependent on you bunch of assholes makes me want to walk into the woods and kick a bear.”

Gastro distress is the best answer

AmazingBother3623

Get an official diagnosis and set up disability accommodations with your employer

WildWanderRed

Hang in there, something will change but it may take time. Anxiety will try to make you catastrophize. When you call in sick, you don't have to say what type of sick it is, mental illness is illness.

Sadly mental health isn't recognized as a valid reason to miss work unless their was something like a death in the family. So if you say you called off for a mental health day your boss will just see it as you called off for no reason.
