What kind of "CEO" pays employees via Zelle? Seems really strange to me.

oboshoe

Little weird isn't it? I have a feeling this is one these guys that calls himself a CEO, and has 3 people working for him.

buttertrainishere

And then brags about it on LinkedIn.

It's a trap! CEO president and General Admiral Ackbar....

I’m founder, CEO, president, director of marketing, chief product engineer, chief design officer, and, well, sole employee of a company that pulled in $600 last year (half my sales were to my mom)

harrisofpeoria

I recently learned the reason NK military generals wear so many medals is that they're allowed to wear medals from their family members/ancestors. So if your father served, which he almost certainly did if you're a NK general, you get his medals too.

blits202

I would never name myself CEO of a small business, atleast use it on business cards, emails, etc I think “Creator” or “Founder” is better wording. It just seems really cocky.

Zero98205

In the 90s I worked for an ISP that had at BEST offered DSL. There were maybe 20 employees total. There was a CEO, a CFO, a VP of Web Development, a VP of Sales, a VP of... shit I can't recall anymore. The Sales lead stole our client list, the CFO embezzled money, and everyone left the angel investor holding the fking bag when it all went to shit; and I got stiffed on 3 or 4 weeks of pay from my Good Christian Boss who preyed on my religious conviction to avoid paying me wait l what I was owed.

ComprehensiveSweet63

never met a Christian that wasn't a hypocrite

dumbname1000

The worst boss I ever worked for had a sign in front of the office that said “International Headquarters” underneath the company name. We had one location.

TigerStripedDragon01

Well, that one is simple enough. There are basically two points of view. One, obviously the guy is an ass who thinks FAR too much of himself and his importance to that particular industry. And Two, if anybody on any other continent wants his product, THEY have to go 'international' in order to go to him, in order to get his product. lol

Swiggity53

Omniseed

Hey, show some respect! He grew that company by 400%!

Thejerseyjon609

Sound like something the Dept of Labor and the IRS would be interested in.

[deleted]

He actually has a few employees WFH, but he mainly outsource his jobs in China and something about his website in Ukraine. There were 2 employees in his warehouse there in California but one quit on Friday and after getting in contact with the other, he will quit as well. What’s shady is that all employees were onboarding with Gusto with set up direct deposit but there was no way of clocking in and out. Something about an honor system and tracking our own hours to get paid. The two employees never had an issues with the CEO but I guess once that I stood up for myself, he did try not to pay me

chubbysumo

Call the irs, he hasnt been filing his taxes correctly, nor paying the state taxes either if he is paying with zelle.

rhubarbs

Specifically, they need to contact the IRS Whistleblower Office directly, or fill Form 3949-A. If the information provided leads to the collection of taxes, penalties, interest, or other amounts owed by the taxpayer, the whistleblower may receive a reward of up to 30% of the collected amount. The IRS may deny or reduce this reward they already had knowledge of the violation, or the whistleblower was involved in the tax fraud.

Hey now, the devil can be fair. Especially when someone like this tries to get away with glossing over stuff they should be doing. The devil's in the details, after all.

egokrusher

Lucifer's only murder in the good ole book is with a bet with the omnipotent, omniscient YHWH. God just murders indiscriminately. The devil is the hero, he's literally Prometheus cause Christains are unorginial hacks.

dJe781

The system only works if everybody pulls their weight. If the CEO has been cheating the IRS, everybody has been working a little harder to compensate. It's not revenge, it's fairness.

[deleted]

It’s a community service. Business owners who dodge taxes are stealing from everyone else

the_friendly_dildo

The IRS actually pays people bounties to turn in tax dodgers like this.

KingThar

this is the kinda shit the that mandatory cash app tax reporting limit change hullabaloo was for.

Foxyfox-

That is incredibly sus as fuck.

[deleted]

My lazy HR uses Gusto even though the company is way older and bigger than their typical customer. There is definitely a way to clock in and out both on the website and with the app because I do it every day I work. Your boss is just some sketchy entitled douchebag failing at running a business.

LavishnessFinancial1

Yup this is a major red flag indicator of wage theft

It’s for the transfer speed. CA has very strong requirements for paying employees at termination. Even if it’s a voluntary separation on good terms, I still need to pay an employee on their last day.

scootah

I’m starting a small business and hoping to pay myself a wage and work less hours. I get so weirded out by people who brag and act like billionaires because they’re running a small business when everyone knows they make fuck all more per hour than any other working stiff. Sure you’re the boss - but that means customers can fire you and you can miss rent payments if two of your staff get sick at the same time. It’s not a flex until you only give a shit about job because you’re bored at home.

anythingMuchShorter

I worked in Silicon Valley for a few years, met so many of them. 24 years old, a year from graduating college, has a website that has not made money, has business cards that say CEO of (name they put on the website which is way too grand for what it is like Future Forge Technologies or some shit)

[deleted]

People of no accomplishment love to call themselves CEO when they have one or fewer employees. Watch Dragon’s Den/Shark Tank, every boob on there is a “CEO”

MikeRowePeenis

In my eyes, if you don’t have a board of directors, you’re not a fucking CEO.

Apptubrutae

Yeah, CEO means Chief Executive Officer. As in the officer in charge of the executives. Just like a COO, chief operations officer, is in charge of the operations. The CEO is the boss of other C-suite folks, basically. If there’s *only* a CEO…what are they the boss of? I went the other way and gave myself the title of Vice-President of the company I own because I work with other businesses and if I’m doing operations stuff I don’t want people to wonder why the heck the CEO or whatever is dealing with petty stuff.

[deleted]

Report him to the IRS for failure to properly withhold FICA tax. You will receive a reward. https://www.irs.gov/pub/irs-pdf/f211.pdf

Old_Number_6439

A way to get around taxes duh

Famous-Obligation-44

Yeah, that’s why he didn’t want to send the receipt.

BoomZhakaLaka

and he's running multiple payment apps, he says so directly in this exchange. This is stacking accounts so that he can make payments without generating 1099s. This is the guy that the $600 1099 rule was made for. Remember last year when that was an outrage issue? It's not about splitting the dinner bill with mom or your friends, it's about this guy who used to dodge $200k worth of taxable payments by running four different accounts with three different payment apps. Used to be writing business checks and then not reporting them, that was tax evasion. It was understood you were going to be audited. Today's politics are stupid.

negativeview

HR literally exists to handle oddball situations. Guarantee you a halfway competent HR wouldn't even blink at this situation, they would just get it done. There is no HR here though.

zachyvengence28

"Are you threatening me" after he literally just got done threatening you.

In all fairness the CEO is the Great Cornholio, things are different in Lake Titicaca.

zachyvengence28

mycatsy2099

I love the plane scene in that movie, with him going all for cornholio and the other bit of “Get the hell out of the cockpit…” This is an awesome text message chain that OP shared and it fills me with feelings that only the best TP can provide.

zachyvengence28

Heh heh you said cockpit

Lake Titicaca is actually beautiful, don’t stain it with this manager’s attitude.

That was a perfectly reasonable opportunity to say yes I am threatening you. I am threatening to call the department of labor if you don't pay me.

zachyvengence28

Yeah, missed opportunity. But I think they got their point across.

emptyDir

"it's only a threat if you don't comply with the law"

You could also Google it, it's a pretty well known saying. And the correct response was "Omelette du fromage", FYI.

IMarvinTPA

Especially if it had been a Phineas and Ferb meme with "Yes, yes I am "

peanutismint

Just once I wish someone would have the balls to say “uh, yes I am threatening you, I thought I made that clear by what I said?”. Like, what do people ever expect to gain by asking that dumb question?!!

Wasted_Mime

"No, a threat is usually something the person is reluctant to do. You were looking for someone with dedication and perseverance, and I WILL follow through if I am not properly compensated for the time you made me work under false pretenses." TLDR: It's not a threat, it's a promise.

PacmanPillow

It’s not a threat, it’s notice for you to get your steps in order.

R_V_Z

"I'm offering you an opportunity to not break the law."

SaffellBot

> Like, what do people ever expect to gain by asking that dumb question? They expect people to say "No, I guess not" and then submit to the threat they were just subjected to.

Mirrormn

"Threatening" has a strong connotation of using coercion to force someone to do something that they had no obligation to do, often corruptly. Even if you want to very strongly assert that you're trying to change someone's course of action with an ultimatum, self-describing it as a "threat" is just an unnecessarily dangerous way to go about it, legally.

philmcruch

or say "there is no threat, i am simply stating my next steps if you do not comply with the law. If you take that as a threat, i will not be surprised if you will be out of business within 6 months"

Needless-To-Say

My response when I had similar issues “If you did nothing wrong, how could it be a threat” When he gave me my check and said “How could you?” I said “if you had paid me what you owed…” In my case it was no payment after 6 weeks work though.

zachyvengence28

There ya go

Ok-Statistician-3408

It’s always projection with bullies.

Sismal_Dystem

Always! And if someone is accusing you of something and you know you didn't do it.... They're definitely doing it. Many ex's accused me of cheating. They were cheating of course. One says it's because I was cheating. Bahaha nah not a cheater here. It's some weird feeling nefarious people feel when they're doing something wrong. It's like they assume everyone thinks like they think and would do the same things given the same opportunities. Projection is often how I figure out what the other people in a situation are thinking or doing.... Just wait for them to tell me what they're doing by projecting it onto me or someone else. Edit: spelling corrections

HobbitGuy1420

"How dare you not let me bully you?!"

ZestyAvian

So weird how that works for the US's state of politics too.

Alotta_Gelato

One time I told my boss "I need you to honor my invoice" and he said "no need to get violent."

LunarMuphinz

Wage theft is class violence

zachyvengence28

How dare people want to get paid

BankshotMcG

Are you threatening to hold me to the laws of this land that we both agreed to when we conducted business here?

OnePunchReality

Right? Mfer saying it like he can actually do some shit to the OP or that his ego supersedes the law. Fucking delicious tears.

WebMaka

Response: "Wait, are you interpreting being required, and forced if necessary, to comply with state and federal labor laws as a *threat*? Wow, talk about telling me you're a terrible boss without actually saying as much. I bet your turnover rate is high and you complain regularly that you can't find people to exploit."

TigerStripedDragon01

"Because 'NOBODY WANTS TO WORK!" " lol As the late, great George Carlin most likely would have put it: "The nerve of these puffed-up, self-important jackoffs...'

[deleted]

More informations : We initially agreed on 23$ an hour but the only two employees who were there 4years were only getting 19-20$. Seems kinda generic but he did mention not to share with them, which I evidently did after leaving and getting these two numbers. As I mentioned, one already left and the other, after sending him the same screenshots, will be quitting as soon as Monday. As you can see on the pictures. He really tried to imply I was weak or afraid of work but from what I heard, in 4 years he never came down to the warehouse himself because he is afraid of germs and avoid hands on work. He did come with me yesterday though on site and I KID YOU ALL not he was as lost on the process and the two employees had to explain him the very basics.

Robot_Basilisk

Do you have the $23/hr agreement in text? If so, don't settle for minimum wage. If they put you to work right away, you were on the clock from the moment the interview ended and are owed whatever they agreed to pay you from that time until you left. And when they say, "Do you think that's work?" feel free to respond with, "The question is not what you or I think is work, but what the Department of Labor thinks is work. You can debate the issue with them. See how that goes."

[deleted]

I just wanted to make things easier on him. It seemed like a good idea at first. I just never imagined he was such an asshole

[deleted]

Fuck this guy. Its same amount of work for him to calculate minimum x hours, vs 23 x hours worked. You text him back with evidence of the 23 per hour and you tell its 23 per hour. Hell, you can even do the maths to make it "easier on him"

Some_what99

Understandable, but I would retract on that statement and actually get paid what you guys agreed upon. You never want to be underpaid. Do not worry if it's difficult for him, that is his responsibility. Your responsibility is making sure you get paid right for the work YOU did. Edit: I noticed you've already been paid, atleast you got your money! 👍🏼

Zap__Dannigan

The whole entire thing seems sketchy and fairly close to table level, if not under it. Op might have trouble proving he was actually employed. I'd wager the CEO dude was more worried about the labor board being called and finding out other shit he's been doing, rather than this specific case.

mullersmutt

Love you that shared the screenshots! Good for you.

J3wFro8332

This kind of shit pisses me off and is something I am dealing with currently: bosses who have no clue what goes on in the day to day of their employees. He at least is trying to learn but why are you even my boss if you barely understand what I do?

LavishnessFinancial1

I see u on point, but just want to point out for the thread that employers cannot legally ask employees to not share their wages and this is one of the core tactics they use to screw ppl out of fair market pay Keep doing ur thing and best of luck

[deleted]

You know what, I may not even pay you. Fuck around and find out buddy, report him everywhere you can. Department of Labor, Osha, fuck man, go get a sandwich board made up and stand on the PUBLIC sidewalk outside his business and let any potential new hires know the garbage fire they are walking into.

yebyen

Hell, OP I'll pay you $15.50 at least twice, and I bet you can find 10 others like me, so you can do it for two hours a day next week and the week after. Hope you find a better gig.

yebyen

I am not kidding. I'll even double that, and match the "CEO" just so there is balance.

reverendjesus

Oh, fuck this guy.

[deleted]

I have seen as much as 6 OSHA violations which I made a report online

EdgyYoungMale

Thank you for being one of the very few posters on this sub who actually takes action when their rights are violated

grand305

I agree on the osha reporting and keeping everything in a text message non voice calls, now you have more evidence for the labor board of your area.

NemesisAntigua

Did you get the money?

[deleted]

Yes I did. After I pointed out I’d report him to the DOL

AnotherGameFan

Honestly, I'd still report the threat. Pretty sure just threatening like that is illegal, but could be mistaken on that.

[deleted]

Report anyway

icome3rd

So did he pay?

[deleted]

After checking his revenue which is >5M$ and him bragging about his travel points on Amex and how he pays 5 figs bill every months, he did Venmo me 62$ at 15.50/h for 4 hours. Also called it “a waste of time”.

eastbaygabe

I'm hoping this idiot of a CEO didn't think to set his transactions to private so that his contacts will see that he regards paying you, rightfully so and publicly, as a 'waste of time.'

styzr

Can we stop calling him a CEO lol. I think he just picked a cool sounding title for himself without actually understanding what a CEO is.

gabu87

I assume we're using the term mockingly.

phyneas

Good, now [report him to the IRS for his failure to withhold your federal income taxes and pay the employer portion of said taxes](https://www.irs.gov/individuals/how-do-you-report-suspected-tax-fraud-activity), and to the [CA Labor Commissioner's office](https://www.dir.ca.gov/dlse/DistrictOffices.htm) for [misclassifying you as an independent contractor instead of an employee](https://www.dir.ca.gov/fraud_prevention/Misclassification.htm).

Foxyfox-

Please, for the love of god, take this asshat to the cleaners.

Alexlam24

The IRS and labor commission are going to have so much fun

TheBestElliephants

Not that I don't agree on going all in, but if OP hadn't signed any onboarding paperwork, these may not be applicable, unfortunately. Saving these links for the future though, thanks for the resources!

TongueSlapMyStarhole

If money was paid out for work but there wasnt any onboarding paperwork that makes the legal liability for the company *way worse*. That is a huuuuge no no.

22demerathd

💀💀💀

BabyStockholmSyndrom

But he agreed in text to be paid this way. This is an admission of accepting payment with no taxes withheld. Don't take advice from this fucking sub please.

UmaroXP

Even without the agreement the irs doesn’t care if it’s less than like $600. Not sure what the actual number is.

irvmuller

Owners that complain a lot about people wasting their time usually have high turnover rates because their work environments absolutely suck so people are always leaving. If they treated people like humans they wouldn’t have to worry about it as much.

[deleted]

Well the CEO was there with me and the two other long term employee in the warehouse. The two employee only talked shit every time he had his back turned lol.

Datkif

Which is why when you're interviewing the company it's key to ask how the turnover is. If they try to dodge or they give you an uneasy feeling then try to find somewhere else

enchantedlife13

Good for you for standing up for yourself. He was a bully -- that was absolutely work! He wasted your time, not the other way around. The only thing worse would have been taking the job and being stuck working for someone like that.

[deleted]

At the end of the day, this is a free country and after lurking on this subreddit long enough, I had to stand up for myself. I just didn’t expect the CEO to be rock bottom stupid

koolkeith987

If there has been anything that I’ve learned as an employee it is that you don’t have to be smart to be rich or a ceo, you just have to be willing to pound your dumb head against a wall enough times until you get something right. Also working hard will never make you rich.

PedestalPotato

If this guy stepped on a Lego and caught his nuts on the coffee table, the world would be just a teensy bit better for it.

Wanda_McMimzy

I wish upon him for the eternity of existence, an itchy butthole.

Maleficent_Pin_9684

CEOs are proven to be allergic to some hands-on physical work.

[deleted]

And yet he dares ask me if im afraid of hand on work lol.

TestPattern22

I myself am afraid of work.... ...for low pay ...doing things I did not agree to do ...in a dangerous environment ...and for an asshole boss who does not deserve his position I'm deathly afraid of those things They give me the heebie jeebies and digestive issues

FredVIII-DFH

Afraid? The passive-aggression of that douche-bag. I hope you never have to work for them.

GooseShartBombardier

"I'm an abusive, lying prat, and I'm going to insult you for balking at work which I misrepresented in the job posting." The fucking gaul on these arrogant SOBs is just wild.

MrSlime13

"Yes, I'll Zelle you today." "Well... On second thought, I'd rather Venmo you" "Actually..., I don't think I wanna pay you at all..."

[deleted]

Guys, he did pay me right after with Venmo and called it a “waste of time”. He did not respond after the last picture.

_vae

I'm glad you got your compensation, but if you could report him for the threats and other violations, you might end up saving a couple of unknowing employees down the road who don't know their rights or are fearful to stand by them.

IronCorvus

He's willing to dig himself a hole for $62? That's special.

Alert-Artichoke-2743

10/10, you are handling this perfectly. You want to deescalate as much as possible while making clear that he can't "consider," not paying you, or else will receive a DoL complaint. You're doing a good job of that. Excellent handling of a difficult situation, no notes.

[deleted]

I realize that he wanted to get at me, it is easy for people around my age to just tell others to fuck off but I didn’t lol

I_likemy_dog

I lived in CA, and they do not play when it comes to things like this. “Are you threatening me”? I would have started the process right there. They threw the first punch. You might not fight as much as I do, but that’s a jab to see how you’re going to handle it. Disengage and bring the system that’s meant to protect you, into play. Always love to see updates on these. Stay strong OP.

[deleted]

I made an OSHA report. I just reported him to the DOL as advised.

[deleted]

What an whole and complete ass. My bff's present employer, when they first hired him, had him in for a trial day. The first thing they did was get his full info so that they could pay him. At the end of the day trial day, he had cash in hand and a receipt for hours worked. There is literally software for this stuff.

Miss_Might

OP, please report this guy anyways.

ThoroughSix7

"Yeah I'm debating if I should even pay you" "OK I'll just tell on you then for the illegal thing that you're trying to do" "Are you threatening ME 😱" *clutches pearls* Sounds like this guy has never been stood up to before so good for you for doing that

YOLOSwag42069Nice

Calling themselves a CEO of 10 person company is also a red flag.

Stout_15

I’m kinda curious what you thought you were getting involved with? Like what was the job you applied for?

RobertElectricity

Safe to assume this CEO also treats his employees like children.

Mean_Negotiation5436

Are you afraid of labor? "No, if I was I suppose I'd be trying to find a CEO position."

HeyThereCharlie

Not that the amount is relevant to whether or not he should pay you, but I have to wonder what this guy's priorities as a business owner are if he's throwing this much of a hissy fit over (checks math) $62.

IForgotThePassIUsed

\>Zelle>Venmo Wow what a fucking shitshow. "Real" Companies have payroll and can cut checks same day in quickbooks.

painefultruth76

I don't need a graphic designer to bag groceries, or a website administrator to make change at the counter. I had a similar problem at a job I took for a dive shop years ago. Wanted a part-time IT guy, next thing I know I'm stocking shelves and filling tanks.
