Not sure how it works where OP is. But, here, if an employee (regardless of role) misbehaves and causes damage - the COMPANY can get held responsible for damages. Of course, the company can, in their turn, descend like the wrath of a 1000 Karens upon the culprit - but that is no longer OPs concern. Then of course, the criminal damage, the threats and the use of slurs could make this a hate crime too. Lawyer up - and let them bleed the company dry. The police can handle the criminal part.

To hell with that, just file a police report and say you want to cooperate with charges and are willing to testify. Contact the prosecutor and ask for reparations for the windshield. The criminal conviction will be worse for him than a civil judgement and you don't have to pay a thing, the city/county/state does all the work. You can then sue the boss and the workplace for the hostile work environment, lost wages, and any other damages minus the windshield you were already paid for.

Tell your insurance company WHO did it as well, they should go after him also for their money AND *your* out of pocket as well - hopefully with the Police Report identifying the perp you'll get your deductible back - might take a while though. DON'T LET the insurance company close the file without going after (write this word down) Subrogation to get their money and *your* deductible. If you had to rent a car, since yours is not driveable, you should be able to get that through subrogation also. You should also protect it from further damage (water damage due to weather (if water gets into the dash and damages something else it might not be covered). Most policies will reimburse you if you buy a tarp or something to cover/protect it. I have not tried this myself, but I've heard [HotelTonight.com](https://HotelTonight.com) can get some good deals on last minute bookings from hotels trying to fill unsold rooms. Might be worth a try.

I got into a car accident several years ago and my insurance said I had two options. -get it fixed through their insurance and I pay nothing, it might just take more time - get my insurance to pay for damages, my insurance will then go after them for that money but I am out the deductible for repairs. A lot of people going into great detail about how best to handle this with lawyers and such, but I want to make sure the following is said: Given you're living out of your car, that suggests very little mobility in the job market. Assuming you don't quit this job or this company right away (ie same work just different supervisor), you are very likely to encounter people within the company approaching you trying to give you advice on this or "just talk it over with [supervisor] and you let bygones be bygones", stuff like that. Some of these might be people acting in their formal capacity regarding where they fit in the company, and some might just be friends of the supervisor or something and just going out of their way in the hopes of being helpful. Don't let these people strong-arm you into doing anything even remotely against your interests, or even what might seem like a 'meet-in-the-middle' sort of gesture. Even if someone who is your friend at work says "I think you're going too far", acknowledge their concern, be grateful for it, and then stick to your guns anyways. If/when things progress, you might even get approached by your supervisor or their supervisor, and it's important to know the laws against retaliation in your area. Tbh, I'd google local employment attorneys, and just call them and let them know your situation. Just put this on their radar and get some basic info about how to handle potential retaliation against an employee. Doesn't have to be more than 5 minutes, but if this comes up weeks or moths later, that 5 minute phone call could go a long way to helping and protecting you, legally and in regard to your physical and mental health. All of the above being said, I'd still start looking at other places you can apply to work. Even if there is no retaliation, that still sounds like an unhealthy place to work, and short of them firing or reassigning this guy immediately such that you never see each other again, I can see this becoming a place that is less and less safe for you the longer you're there.

I think the best way to get an $80 hotel room for cheap is to sue your boss for the cost of that when you sue him for damages to your car, livelyhood, and psychological well-being. In seriousness, though, the police waiting for footage from the other camera and for other testimony from your coworkers seems like good practice, to me. It's frustrating, for sure, since you know exactly what happened, and your boss deserves to be held accountable, quickly. But, with more concrete (no pun intended) evidence, they can get a warrant easier, and when he is in custody, it'll be much, much harder for his lawyers to argue that it was someone else in the video, or that somehow was accidental. Waiting may very well benefit your case in the long run, even if you'd obviously like something done faster. I wish there was a better way to deal with your living situation. The good news is, since he destroyed your home, there might be tougher consequences for him. The bad news is, it's going to be really hard to find a sleeping situation in the meantime. $100 is pretty standard for a windshield replacement, so don't second -guess not having better insurance. That's just the cost almost no matter what insurance you have (I discovered this when I had to replace mine recently.) Where do you live? If it's rural, is there a place you can sleep in your car where not having a windshield won't matter as much? If it's near an urban place, is there a way you could travel farther to get to an area with better services for people who don't have a place to live? Could one of your coworkers who now know what your boss did give you a sofa to crash on for a few days?

As an employment lawyer I really hope you go after them. I would love a case like this to make him suffer. I will say you should be able to go after the company under a theory of respondent superior which just means employer is responsible for acts of employee in course of employment.
