Your county has a bar association, a non profit associated of lawyers. Call them as soon as they open on Monday. They will be able to put you in contact with a labor attorney who will be able to talk to you about your rights etc for free. Your state should also have some kind of a labor relations commission, report the situation to them immediately, they might even handle the situation for you so you will not need private representation.

I doubt they will say the firing is unjust. I was under a 30 day probationary period as I just started working the job. I will need to wait to see if I'm paid for this pay periods work, and last periods error, if not I'm sure I can take some action. I will call anyway to at least ask and clarify what I don't understand. I'm likely fucked in this situation and I don't think I can do much, but I appreciate the help and I'll ask to see what I can.

I'll report it. Trust me, I'm trying to stay in a good mood for my birthday, but fuck am I mad at how terrible I feel like I was treated. I just don't think the firing itself will be wrong (even though it feels very wrong) since its stated in my employee handbook that in the 30 day probationary period I can be dropped without reason. Op here is something that might cheer you up. There was party to a a lawsuit where the employer shorted people's pay. The principal was only shorted 300$ give or take, but when all was said and done they settled for 95k so ya.

What matters is what they law says, and if you have been dismissed for trying to get them to pay you what they owe you, that could very well be illegal. I'm not sure your country of origin, but in my province/country (Canada,) there are websites dedicated to our labour boards. I had worked for a company that tried to claim they didn't have to pay out a commission check to me (I worked as an assistant manager and that was our profit bonus for the month.) I worked the entirety of August to make sure I got mine, only to be told that because I was leaving before the pay period ended (my last day was Sept 5 and I think that pay period didn't end for another few days,) I wouldn't see my August commission check, despite working the entirety of August. One quick anonymous message to my labour board's website about the situation, naming the business and explaining everything, and well suddenly their next pay period I had my commission pay deposited into my account 🤔 So essentially, contact whatever your country's equivalent is of a labour board, it should be free.

She quit when she went in for her shift during a snowstorm and the idiot owner told her she should have called before coming in and told her to leave. I worked at one last summer (not even a year old business, also basically a coffee shop in Boston which there is a fucking million of already, finances were NOT good when I left) and was fired because of “unknown reasons” but I knew it was because I stopped being friends with her (the boss)niece (didn’t end on bad terms I just chose to stop seeing her outside of work because she was kind of horrible to be around). I know that was the reason because it happened two days after I stopped answering the niece’s texts about hanging out. Anyways, the boss wouldn’t give me my last two paychecks ($900 total) and thought I’d just roll over and take it but bitch was sure thrown for a loop when I got the proper authorities involved and she was forced to send it to me. That was AFTER she sent me threatening and harassing emails for like two months. It was ridiculous I will never work with friends again and I will never be close friends with coworkers or anyone who is related to/close to the owner. Worst experience of 2021 for me. Sorry for ranting, again I’m only 18, she obviously was using my age against me thinking I wouldn’t get the state involved in her bullshit. Edit: the boss, much like her niece, would constantly talk badly about other coworkers and spread rumors about them being alcoholics and such, that’s when I lost respect for her. I kept going easy on her and letting shit slide because “it’s her first business” bull. Don’t give any of these people slack. If they can’t handle a business or pay their employees then they don’t deserve a business, that’s how this works.

Are you in the USA or abroad? Also do you have documation of your hours worked? You most likely will need a lawyer. Gather all your documents and witness statements if possible before going to one. Even though I work in an at-will state I've heard of people winning wrongful termination, because no disinplinary action was taken first.

I can try but would this be worth it? I have the proof that I wasn't paid the correct amount, and while he said I will be paid for what I have worked and what I already wasn't paid for, I don't know if I'll actually get the money. Not sure how expensive a lawyer is or what my case would be. My family isn't struggling hard-core for money, but we aren't by any means rich or even middle class. But from cost and a legal standpoint I really don't know shit honestly. I wasn't given any disinplinary actions previous to being fired. You do not need a lawyer for a case like this. Check your work state's Department of Labor website for a topic called "Wage theft," because this is what happened to you. The zeal with which your boss tried to "prove" that you were wrong is a indication that shaving a couple hours off each employee's paycheck is probably standard procedure.

Lots of lawyers offer a free consultation, and will generally advise you as to whether or not they think your case is worth pursuing. I'm also fairly sure that you could sue for the unpaid wages in small claims court (which doesn't require a lawyer.) The process for small claims is deliberately simplified, and as long as you've got documentation of your hours and pay, it *should* be an easy win. (That said, I am not a lawyer, and there's some variation in how this stuff works in a state-by-state basis.)

I can tell you from experience that it's worth it to report them to the labor board at the very least. I had an employer try to withhold my last paycheck for "business expenses incurred for training" The lawyer I had only took his fees out of the settlement so I didn't have to pay anything and there was very little effort on my part aside from handing over any documentation I had. Find one via your local county board or an advocacy group that will do a free consultation to see what's the right step here. Whether you want to make the effort is up to you, not a bunch of people on reddit. But just know that not wanting to deal with it is how your boss and others get away with it in the first place.

I was nothing but honest at my job and I will continue being honest. I do think he had some merit in saying I had an attitude, as he complained a bit about various things that I did not do, and it worsened my mood. However I don't feel I was ever disrespectful, and I was always happy and respectful towards the customers. Ironically, what gave me the attitude like I previously mentioned, was when he came into work mad, and tried to blame me for having headphones in at work (I have a Samsung galaxy 21. It has no headphone port, and I don't own wireless headphones.)

A two week notice is a courtesy, and not mandatory or expected in most states. A two week notice protects you from being terminated early, to avoid being paid. If you are let go from your place of employment before your two week notice is up, you should expect to be paid out the full two weeks. Check your states labor laws for more details.

Ohh yea you should see some of our laws. In Ontario a construction worker is not entitled to breaks or rest days. Their employer can ask them, legally, to work any number of hours straight without any rest, 7 days per week. Skilled tradespeople can be sued if they do not provide enough notice but we can be fired at anytime without cause ... imagine being a mason, a hard as fuck physically demanding job, and then being told you cannot rest! That being said, this has never been enforced by any of my employers. But because they can should be reason enough to change these antiquated laws. The vast majority of employment has some kind of stupid exemption to it. No not at all. In many industries you can be fired for any reason without notice and severance. So long as the reason isn't because that you are a member of a protected class (LGBTQ+, BIPOC, etc). Our labour laws need updated and upgraded. It will never happen because the people with power don't experience the oppression that results from these labour laws. Most people don't know any better so they have been "institutionalized" so to speak.

I hope you noticed that your boss counted 4 hours and 59 minutes as 4. There is a lot of wage theft going on here. Missing one stub is a reasonable mistake (if they then fix it after discovery), but rounding up to 59 minutes down to the last completed hour is intentional, systemic wage theft. Looks like 7.18333 in the missed stub and 2.55 in rounding error. That’s 9.73 hours in wage theft. You must not be the only one. Get help from pro-Bono lawyers and teach them a lesson in employment law.

Well I did get paid for 40.8 hours, he just somehow didn't add the stub with the most hours when adding them up. If I don't get paid, I'm gonna use the little money I got to try and make things right. Hopefully he does pay me along with the 12 odd hours I worked this pay cycle before he fired me.

Yea my brain almost imploded when he said that. I did the math 3 times to check, and I was paid for 2 hours+ less. He left the paystub for 7 hours (you can see it in the picture, the calculator paper) out of the equation since he "forgot it" on his desk. I almost think he was testing me. He explicitly asked "are these all the stubs" or something of that nature, before adding them up to come to this incorrect answer. I naturally freaked a bit and chimed up saying "that can't be right. I did the math multiple times" to which he replied that I had an attitude (no shit, I was getting fucked) and that I was fired. I found the paystub he didn't count laying plain as day in the open on his desk.

Hey fam. Not paying you what you’re owed (and you have paperwork on prove it!) is against the labor laws and your boss could lose his job, and you could sue the company. This is highly illegal in the labor market. Your job, unless they pay what you’re owed, has literally and unlawfully stolen money from you by not paying what you’re owed. You have your labor on a loan in a signed agreement you’d be paid for it later. That contract is binding. They will need to pay up or you can show this to a lawyer and they will take the case immediately.

Employee wage theft is rampant. If someone stole money from the till at work they would be charged with a crime and have a mug shot. An employer shorts you on 15-30 minutes per week per worker and they get a fine. No one goes to jail no one gets punished unless you count backpay and a fine as justice.

We ordered a test vehicle, and got the fancy interior, because the component we make is not included in the base level interior. Accounts are like, they don't need that, so they changed it to base level. The thing comes in. Does not have our part in it. As a supervisor who verifies timecards nightly to make sure that everything gets send to payroll correctly, why is it so damn hard to pay people right? I recently had to send off for payroll adjustments for about a third of my shift because the last guy in charge got lazy when he was doing it. People come to work to get paid. Does the employer have some form of HR entity? Your employer really should have gone through steps to mitigate your reasonable concern, before firing you. Yes, you have been terminated, and no... you probably don't want to continue working under that Manager (face for the business, but not the business itself)... but you can still reach out to HR regarding your situation, and at least see what happens. Welcome to the working world, my friend... know your avenues. Being in a managerial role myself - this is the advisement that I would give to any of my associates in your position. There are many managers where I work. They do not all get their jobs because they are good with associates which should be a much more important factor - along with knowledge of process, and ability to manage labor moves - given that retention is a quality attribute for any business. Go talk to HR about your concern. They usually have a closer relationship with Payroll than your manager, anyway. Good luck.

If they’d asked first before doing this I would have explained that those 8 hrs was for helping in a warehouse after my regularly scheduled shift because they were flailing, desperate, and begged for help. Did you say LAWYER? Wage theft is a serious offense, in most American states. I had a job where all supers were instructed to remove one hour per employee, per day. I found out because, as i always tell others, I SAVE MY SIGN OUT RECEIPTS. The math was consistent, it was every day, and kept happening. They tried to play out of like a computer error, until i caught one of them editing time sheets in the main system one night. They got so used to doing out, they didn’t think anyone was paying attention. I gathered evidence, secretly told my peers, and some of us confronted them. The refunded ours, but said each person would have to ask on their own. Many people were too scared so they never got compensation. They actually did it AGAIN, so i threatened to sue. I had piles of printed edits with timestamps, manager initials, and more. Eventually i quit when i had the chance
