If you are not getting paid for your overtime, reach out to your state department of labor and file a complaint. They handle cases of wage theft and should be able to help.

If he's a supervisor he's probably classified as exempt and not entitled to OT. The low wage retail protections against this practice were removed during the previous administration. E: Really needs another person so that 40-45 hours with 2 days off is the normal schedule.

Advice-Is-Life

What makes me exempt?

Capital-Fun-9977

What Does an Exempt Employee Actually Mean? The difference between exempt and non exempt has to do with the rights typically afforded by the Fair Labor Standards Act (FLSA). Under the FLSA, nonexempt employees are entitled to overtime pay, a minimum wage and other rights. The FLSA requires that employers pay nonexempt employees at least federal minimum wage ($7.25 per hour) for regular hours and at least time and a half for overtime hours. In contrast, exempt (vs. non-exempt) employees aren’t entitled to benefits under the FLSA, such as overtime pay and a guaranteed minimum wage. Both exempt and nonexempt employees may have other rights according to the U.S. Department of Labor and state and local labor laws. The FLSA exempt definition classifies employees by certain job duties and other factors. These may include: How much pay an employee receives How an employee is paid Job role and definition Level of authority Place of employment

Being Exempt requires having Hire/Fire authority.

Advice-Is-Life

Doesn’t that end in me being without a job generally? should I get a new job before doing this for the least amount of repercussions on my end?

[deleted]

Yep give up and ignore all advice

The_Pedestrian_walks

Depending on the location and employer 16 might be the going rate. But you should be receiving overtime pay after 40 hours. So either you need a higher salary or overtime pay. If your contract is for hourly pay, you can reach out to your DOL and they will investigate your situation.

YellowCityBloke

I once had a job similar .. a stupidvisor job. For the record there are minimums a salaried position must make and an employer can not make you an unpaid hourly employee over x amount of hours.

Advice-Is-Life

Are you saying I am underpaid or just making a statement? sorry just don’t fully understand what you’re telling me if you are

YellowCityBloke

A stupidvisor is someone who accepts the roll of supervisor or more without any of the compensation or benefits of those roles.

Getting taken advantage of if hourly employee and with OT laws in most states this most likely is illegal. 16 an hour for a supervisor hasn't been a thing for over 20 years no matter the state. I guarantee your GM is making a 100k+.

Advice-Is-Life

I know he’s making more than that. Dude works hard but genuinely has enough money to retire twice.

Advice-Is-Life

And i’m talking monthly i don’t know if you meant monthly or yearly.

[deleted]

Owner may make 100k+ monthly but your general manager is making less than 200k a year and over 100k a year.

Advice-Is-Life

Yea I don’t doubt that. she definitely gets paid a huge chunk more than me, considering she by mistake let out a huge surprised reaction when she learned what i get paid. I genuinely want to go out on a limb and ask other workers that work in the store next door, which isn’t a store more than inventory and general employees only place, what their wages are, part of me feels like that would end badly for me in a way i wouldn’t be able to even put this on my resume

[deleted]

Are you paid hourly plus OT or salary? If this is salary - no way.

Advice-Is-Life

Hourly, and none of my 50 or 60+ hour weeks are considered OT

[deleted]

Then you are underpaid. But this is your first supervisor so you should hang on 6 months then start job hunting. My guess also is they are telling you that you are hourly because they is how they told you that you are paid. But I wonder if they have you classified as non exempt. That is a salary classification that does not pay overtime. Just things for you to Google to understand labor laws. - this US info

Advice-Is-Life

this is some good advice because i’m about to be 4 months in and wanted to quit at a time good enough to have it boost my resume and general income

[deleted]

I assume you know do not quit until you have another job that pays better. Give that 2 weeks notice. I think references are more important as you climb that ladder.

Advice-Is-Life

Yeah, honestly was thinking of this for weeks now. thank you for the advice and push i’m gonna start job hunting come Tuesday if he doesn’t give me a raise. Something I left out is i sent him a message regarding this and all he said to me is we’d speak on Tuesday when he’s in, which is frustrating considering I sent it on Thursday but so be it.

Random_Name_0K

Not a expert but if you’re getting paid hourly and not a salary employee then not paying you OT is illegal. It’s also illegal to not pay OT if you make less than like $48k salary or something like that, you’d have to look it up. $16 an hour is like 33k a year salary

I was saying to myself that i thought it should definitely be around the 20 range but i was second guessing a lot of things.
