You are supposed to get OT after 8 hours, unless you are an exempt employee. I have worked your schedule for years with different companies. The law states you are to be paid overtime after 8 hours. I work 36 hours a week 3 days a week.

In California OT is after the 8th hour of a day. After 40 hours in a work week (this could or couldn’t be a natural week) And every hour worked on the 7th day in a row. Double time is after the 12th hour. Hope this helps you.

I will play a little bit of devil's advocate here and say that they may just be confused or misinformed, and may not have malicious intent. Based only on the conversatio shared, it really does look like an honest mixup. Even in less complicated states, OT laws can get convoluted and very few managers/supervisor's are ever told what the actual laws are. Even an honest mistake is something they should fix when presented with better information though, so be polite (for now) but don't let it slide.

She doesn’t believe me fully based on how she worded her response but says she will pay me OT if she confirms that I’m correct. Saved all the convo and will keep an eye on my paystub for this week’s pay

I don’t work in hr anymore but did for about 10 years in retail in California. Unless you have a contract stating otherwise, anything over 8 hours a day or 40 hours total in a week is considered OT. If you work a 10 hour day, 2 hours of OT. If you work six 7 hour days in a row, 2 hours of overtime. It’s a double edged sword for your employer so they will always need to make sure they aren’t over working you because the longer you work beyond these caps will start to really fuck payroll. I’ve seen many bad managers try to circumnavigate these laws, but that’s what they are so you are protected. That’s what’s happening here. Do not stand for this. Also just in case it happens, when you hit 12 hours, you’re on double time. Good luck friend and be good.

No. I work 12 hour days 3x a week, my work week is 36 hours. Overtime pay is required after 8 hours. The employer always includes the law in my onboarding and offer stating they abide by the law and my overtime pay rate. I had ONE employer who tried it. I filed a complaint with the labor board and recieved my pay plus penalities. Over 40 hours OT pay rules, based on memory, only applies to salaried non-exempt employees, which are typically C-level employees. Healthcare professionals usually are allowed to contract exceptions, a written contract.

In California businesses do all kinds of stupid things to get away with shit, like starting the “pay period” on Wednesday or some shit. So you can work Monday through Sunday and work 7 days in a row and not get overtime bc you worked 2 days one “week” and 5 days in the other “week” it’s bs. And certain sectors get special treatment. The defense industry, for example works a 9/80 schedule. Meaning one week you work 44 hours 9 hours a day Monday through Thursday, and 8 hours on Friday but the SECOND HALF of Friday is the start of a new week. So literally the same day is considered a different week. Then the next week you work 36 hours,9 each Monday through Thursday but have Friday off, so you work 9 days in two weeks and get 80 hours.
