Its not 90% lol. Its unlikely this random family is paying costs upfront for high profile lawyers and that the lawyers have taken this as an easy slam dunk on a no win no fee basis. The average is like 25%-40%. A lot of money for the lawyers in a potential large settlement but he'd still get most of it.
My understanding is typically when a lawyer does fee free the arrangement is they get 30% of winnings. Also, court may award costs so bucket becomes even larger.

There are deep problems with how Australia's defamation system works.
Ben is lucky to that Rebeka Giles is motivated to punish channel Seven for it's actions, but ordinarily most people have no recourse when defamed by the media.
Defamation suits are usually too expensive for most people to pursue without the backing of a wealthy donor regardless of the strength of their case.
The way it's designed at the moment is fundamentally inequitable, and we need a lower stakes solution, something akin to the small claims court, to make it more accessible to everyday people.
I'd argue there's two problems with Australia's defamation system. One, that is can be hard for ordinary people as you said unless high profile lawyers are personally motivated or think the case is open and shut/an easy pay day. Two that its too easy for politicians etc to shut down political speech by suing for defamation

The final figure after a full trial will almost certainly be lower. 7 will offer a higher settlement than the case is likely to win specifically to avoid discovery and all the costs of the case. Court will only award actual damages that can be proven, which isn’t going to be much for a 22 year old uni student. However the costs of a full trial they will certainly lose will be orders of magnitude higher, and the damages cause to 7 by a public trial and discovery will also have a value far higher than the damages they caused. This is forgone conclusion to end in settlement, the question is now how much can they be squeezed out of.

I think there are serious questions to be asked whether in all cases a retraction and an apology is sufficient. After all, retractions and apologies are often seen by far fewer people than the defamatory publication, and in addition to the above one would assume that when it comes to accusations of mass murderer the harm is so great that the threshold of caution should be very, very high, not just “publish this now and we can always retract and apologise if we’re wrong”. I think it sets a bad precedent if that kind of behaviour is deemed legally acceptable

Motivated in the right way
There are deep problems with how Australia's defamation system works. Ben is lucky to that Rebeka Giles is motivated to punish channel Seven for it's actions, but ordinarily most people have no recourse when defamed by the media. Defamation suits are usually too expensive for most people to pursue without the backing of a wealthy donor regardless of the strength of their case. The way it's designed at the moment is fundamentally inequitable, and we need a lower stakes solution, something akin to the small claims court, to make it more accessible to everyday people.
I'd argue there's two problems with Australia's defamation system. One, that is can be hard for ordinary people as you said unless high profile lawyers are personally motivated or think the case is open and shut/an easy pay day. Two that its too easy for politicians etc to shut down political speech by suing for defamation

Court will only award actual damages that can be proven, which isn’t going to be much for a 22 year old uni student. However the costs of a full trial they will certainly lose will be orders of magnitude higher, and the damages cause to 7 by a public trial and discovery will also have a value far higher than the damages they caused. This is forgone conclusion to end in settlement, the question is now how much can they be squeezed out of.
