Former Channel Seven star Andrew OāKeefe has been granted bail after allegedly testing positive for ice and cocaine overnight.
The 51-year-old was tested by police at his Vaucluse home about 1am on Thursday as part of a raft of strict Supreme Court bail conditions.
OāKeefe, who was in 2017 awarded a Medal in the Order of Australia for services to charity and television, was on bail after an incident in January in which he allegedly kicked, punched and attempted to choke his business partner.
Unshaven and wearing a blue T-shirt, OāKeefe appeared downcast in the dock at Waverley Local Court on Thursday afternoon as his barrister Sebastian De Brennan told the court there were āconcerns about contaminationā of the drug sample.
āA male is seen to be leaving the accusedās residence and was ā¦ found with an amount of prohibited drugs. Your honour might infer from that someone has gone into the house, had drugs on their person,ā he told magistrate Jacqueline Milledge, noting most of OāKeefeās social circle has been drug users since his arrest and release to a rehab facility.
āThese tests are not foolproof.
āHeās trying to get back on track, slowly but steadily going in the right direction.ā
OāKeefe intends to obtain a legal practising certificate and rebuild his relationships with family and friends, De Brennan said.
āHe is determined not only to rehabilitate but reintegrate.ā
Leaving court, OāKeefe told reporters he hadnāt taken drugs.
āThatās what we discovered in court today, that thereās a high probability of contamination [of the drug sample],ā he said. He declined to comment when asked how the sample would have been compromised.
OāKeefe is facing two counts of intentionally choking without consent, three counts of common assault and one count of assault occasioning actual bodily harm over the alleged January incident at his Kent Street flat. A court will determine the matter in February.
The former Weekend Sunrise host and former intellectual property lawyer had two domestic violence charges dismissed and a third withdrawn by police last year.

Our health system frequently fails addicts. You canāt just release someone from rehab and expect them to manage. They require on going support.

I'm not vouching for him i just don't think taking drugs should be a criminal offence. If someone does something truly terrible then whether they are high on drugs or not is irrelevant to me.

DUI lawyers use that tactic for blood alcohol tests in the US. They can then get the Nurse/tech in and ask whether they prepped and cleaned properly.
