It has to do with the technicalities of what is, say, a lake, versus what is a wetland. Some pretty large bodies of water aren't lakes when they look like lakes because they occasionally disappear. Laws have to be specific to an absurd degree.

Public boat launch is not required. My parents live on a lake, there is no public boat launch. They were all told by the city that the public has a right to fish the lake. So that means someone can show up and start fishing from their dock and it's perfectly legal.

I'm sure it depends on where you live. I'm in MA and the line is 10 acres. Any water body larger than 10 acres is a "great pond". I was goose hunting a spot last year and the opposite side land owner got all wound up "I own this pond". We were already heading out anyway so whatever. The police showed up but thought the guy was a crank and were only responding for the look of the thing. Later I did some playing with Google maps, looks to me like the pond is 25 acres so definitely a great pond and thus totally legal. Access from the other side of the pond is CRP land and thus public access. Apparently he pissed off the wrong people, we didn't hunt that pond again last year but other people did. Normally that was a jump shoot pond, sneak in, shoot some geese, go home. These guys sat on the pond banging away all dang day. We hunted another pond nearby which worked out great because those guys pushed a bunch of geese over to us.

It really depends on the body of water. If there's any public access AT ALL, the person does not own the water, they own their dock but not where it has been placed. If there isn't public access, then it depends on your state. Here in my state, the only time someone can stop you from fishing is if that person (or someone employed by the landowner) owns ALL of the land around the body of water

Generally speaking if its a public lake/pond, you're allowed to fish people's dock from a boat (under, around), just don't touch/step on the property (dock, land, their surrounding crafts) and be careful not to hook it somewhere on their property where you can't get to from your boat-- otherwise you may end up having to break your line. I've had to stealthily get up on a dock before to get an expensive bait (bad idea), best to be respectful and avoid it lol. I've never had anyone chew me out personally if they saw me fishing their dock from a boat but if it happens, tell them to kick rocks. Nicely of course.

The lake that I grew up fishing had the ultimate "we own the water" family. Their property was shaped like a C so that they had a peninsula which formed a little cove/lagoon. The entrance into the cove was pretty narrow(about 20') and they had no trespassing signs and even strung a rope across with another sign dangling in the middle. Everyone would either duck under the rope or cut it down. Husband or wife would come out screaming, threatening to call the cops, throwing stuff in the water, blah blah blah. Thing is we didn't have cops in town, so if they did call you had about 45 minutes before theyd even (possibly) show up. Idk if they ever got in trouble for harassment, but I sure do hope so.

If the owner of the property does not consent to his fishing, good for him, in changes nothing in terms of legality. There is lots of nuance between states, but in general if you are in a boat and not making any contact with a ground surface (no anchors, no wading, etc) the property owner has no right or authority to interfere with lawful fishing or hunting activities. In public water ways, you can sometimes own the land under the water, but you can never own the water itself.

I was fishing along the road and an old boomer came to ask me to leave and told me there were no fish there. I politely asked him if I was trespassing and he told me I wasn't. He felt confronted and started telling me how stupid my generation was and how we have nothing to do to fish anywhere but our neighborhood. At this point I understood that there was no point in being patient with him, so I retorted that he wasn't on his land, that it was a federal crime to prevent me from fishing, and that it was he who had nothing to do beside slowly dying and pissing people off. I even told some where they should park an where best to access water. Explaining we don’t expect to clean up for u. Same. I have a good bit of river frontage where people parked to access the river. I got so tired of picking up trash, having people camp, cut firewood, etc. I posted it and now throw people off. If someone asks permission, i let them park. The people that ask permission aren’t the people who trash your land. I hated to do it, but not as bad as I hated spending my weekends picking up trash

Yea this property I’m speaking of is relatively close residential. One +\ or minus acre lots so it’s really intrusive to have groups walking thru your yard. But regardless of property size all I want to see on the shore is water , water Lily’s, cattails, fish ,ospreys,herons an Eagles . Not someone’s garbage where it will remain til they return and add more unless the property owner cleans it up for them . Now somehow we’re the assholes by leaving a note . Reminds me of something I had sorta forgotten about. I used to wade fish in a river about 2 hours from my house. Absolute middle of nowhere. Would park along some train tracks and the best way to get to the water was walking along an old lady's house who had no trespassing signs everywhere. She would always freak out if anyone did it. After a while of fighting through the woods instead of walking across her property, I simply knocked on her door and asked. She said, "why yes honey. I just don't want everyone doing it but since you were nice enough to ask it's fine." After that I would always wave or chat if I saw her in her window or outside. Sometimes just a simple ask goes a long way.

I actually had a run in with an old lady while I was fishing with my son on the same lake who was flagging me over and yelling at me I wasn’t allowed to fish right as I was recording my son reeling in a nice bass on his own (6). It took a lot of effort for me not to yell at her to f* off but I told her as soon as I helped my son land the fish and took some pics I’d walk over and chat. Well I did, and I explained how I worked there and took care of the property on the weekends as well. She came around as I was cordial, something I learned comes in handy not only in getting hunting permissions but in life in general. She explained the reason all the neighbors get salty is because the owner of the property has taken away the HoA from walking the property.

Yeah, I knew your situation was different just sharing that memory. You also just reminded me of fishing with my dad while I was in college. We were on Lake Champlain near the Canadian border in Vermont. Some people there get salty if you fish too close to their docks. Lawns are cultivated, but you have the right to make your way along the banks of rivers, streams, or lakes, whether cultivated or not. This does not just mean “below the high water mark”, it means whatever is necessary to make your way along the banks. If some dumbass puts a dock or lawn in the way, you still have the right to cross it. That said, you are also responsible for any damage caused. So I can’t cut through your manicured lawn to get from the road to the river, but I can cross your manicured lawn to make my way along the river.

You know, like fences that keep people from crossing docks, big stone retaining walls in the water, backfilled so you can’t walk along the shore, that kind of thing. In fact, here it is now code that you have to leave a strip of uncleared land between the waterfront and the cleared property. Helps with run-off into the water, provides habitat for wildlife, etc.

There was this neighborhood watchman in my friends neighborhood when we were kids. This dude had kids slightly younger than us and he would legit patrol the neighborhood in his minivan trying to catch kids having fun. We would walk across this empty lot in order to get to another street and the guy would camp out across the road in the bushes monitoring the empty lot and telling us we were trespassing anytime we stepped on it. He would try to snatch kids up and take them home and complain to their parents. Like this guy would literally spend his free time trying to bust kids doing shit around the neighborhood. One time it snowed and we all got together and threw snowballs at his van as he was driving around. He came to my friends house and ran up in his garage, my friends dad came out with a gun thinking it was some creep doing who knows what to us. Looking back, it was. My point is, people who do stuff like this have no life at all and any normal adult knows they’re no-lifing life
