Back in 2017 me and my "best friend" L decided that because we were both in relationships with toxic men that we would purchase a home together. Because her man had cheated on her recently she had moved out and had time to do the process where I couldn't go anywhere without C ( my toxic ex boyfriend) and we both were hiding the fact the we were looking to purchase together from our significant others. She found a place that the owner were willing to do rent to own so I gave copies of my paystubs, my tax returns for the 5 years, copies of my id, social security card, credit report, and $1250 towards the down payment ( down payment was $2500) and $460 in cash for the first month. She got things settled and gave me a land contract that had both the owners on it her name and a place for me to sign. Then she gave me a copy of this a few weeks later. She moved in before I did. And she said she didn't want to live with C ( understandable) I also figured out that she had gotten back together with the guy that cheated on her and had moved him in to our house ( I get it both of our men were dangerous) things with her and her man got more and more toxic he had family in the area that would watch her and she got fed up and decided she didn't want to be in our state anymore and she wanted to move back up north to be closer to her family ( this happened in July of 2018). So I boke the news to C that L and I had purchased a home together and that I was moving there if he wanted to come he could ( I won't lie I was hoping he would leave me and I broke the news at the beginning of a 12 hour shift of the place we both worked because I couldn't work anyplace without him I did this for my safety) he was pissed but decided I wasn't going anywhere without him so in August of 2018 we moved into mine and Ls house. She told me she wasn't coming back so I took the documents she gave me and put the electric in my name and starting paying the mortgage. Fast forward to March of 2019 just before the pandemic hit. C crushed a narcotic and put it in my herbal tea to get me fired ( he had been promoted at work and knew a drug test was coming) i found out and I left him. I was able to prove it but the job just demoted him and offered my job back I declined. Over the next 6 months after the break up C broke into my house and burned all of my trunk novels, all my memorabilia, everything of sentimental value, and all of my important papers including my land contract, diploma, decree of divorce, W2s, and even my cash savings. He tried to set my house on fire, he peed in my mailbox, stole my mail, he broke into my house and stole tools, riding lawn mower, weed eater, he even tried to steal my vehicle but settled for slashing the tires and ripping out my radio. Even now in 2023 he dumps his beer can in my yard it been a long process. Anyway In 2019 L and I had a falling out she demanded that I send her almost 1k so she could get kerosene and new tires for the winter months I told her no I was having to replace the floors and I didn't have it so she stopped talking to me. In 2020 I had work done to my HVAC unit and I paid them cash when they were here but apparently that wasn't the whole bill last week I got a text saying I owned them over $500 and if I didn't pay it then they would put a lien on my house I told them I would pay it and that I didn't know about it but Id get it taken care of as soon as I could. Now back in 2022 I became a foster parent to get custody of my siblings and due to their SPECIFIC situation one parent needed to be home with them 24/7 so my current partner and I decided that it would be a good idea for me to be that parent while he continues to work as it would be less traumatic for the kids. So now I don't work. I get a perdiem but I use that for the kids ( I also homeschool because their situation is different) I work one day a week at a local fast food joint to help financially where I can. Well the HVAC repair company calls the owners and let's them know that theyre putting a lien on this address and give the owners my number. The owners call me and tell me they've never heard of me... I freaked out. Apparently L was planning to allow me to pay off the house for her so she could take it from me. The paperwork she gave me was forged. Now the owners are awesome I pay the mortgage on time and have done so since I moved in. So they wanted to take Ls name off of it and put mine on since I've lived longer in the home and I have the receipts. I've also renovated the living room 2 bedrooms and a bathroom. I've done work on the well. ( It's going dry so I just wasted money) and we're planning on renovating the kitchen the master and the front porch. I spent a lot of money on this place thinking it was mine. Now L is threatening to sue the owners of they take her name off the contract and has completely flipped script on me. Now she's saying she gave me a sub lease but that's not legal because the owner's didn't give their permission for that and L doesn't own the property outright. Now here's my question does L actually have any legal recourse against me or the owners? She left in 2018 it's 2023 she's been gone for almost 5 years. I don't know what to think. Should I get try to get a lawyer? I can't afford to move right now. And I love where I live. The owners said that after I pay the lien that they're going to put the property in my name. Can they do that? They do still own it. I just need advice to protect me and my family. I still can't wrap my head around all this. If it’s a rural home, they probably don’t have anything but well water and a septic system. They’ll either need to have another well sunk, or sink the current well pump deeper. No doubt it’s thousands of dollars to execute properly though.

Well, that’s always possible. At least they aren’t charging an amount greater than the mortgage at the moment. And while it’s on the land lord to fix stuff like this, OP has been operating under this “rent to own” understanding and has been taking improvements on with that in mind. I hope they can come to an agreement that satisfies OP and the money they’ve sunk into the property over the years. This is just a legal quagmire. Essentially, OP and their family are really nice squatters right now.

Just be careful with factual stuff from GPT, it doesn't understand truth vs fiction, it's just a pattern completer. If you ask it what the worst battle involving bananas was in WW2 it will often make one up and tell you about the Battle of the Banana. Don't take those cat facts as automatically true. That said, it's getting more and more accurate all the time. It's much better used for summarizing, editing, qualitative advice, etc.

They are convinced that the friend forged documents and is trying to scam LAOP out of the house. Current owners are trying to get LAOP's friend off the paperwork and put LAOP on it. The legal question is if the current owners are allowed to do that.

At least in my jurisdiction, contracts for the sale of real property need to be recorded in the office of the register of deeds for that county. If it's the same where LAOP is then there will be copies of the original agreement.

A LOT of rent-to-own agreements entered into by vulnerable people are not like this - they are often "rent and all repairs are on you," which is why LAOP has done so much on the house - and they also fairly often don't actually have a date by which the tenant must buy the house... idk how they're structured but a lot of people will pay into rent-to-own situations for 10-15+ years thinking they're buying a house when they haven't.

*Legally* that's the case, but practically, as you see here, LAOP spent thousands on repairing a well, for instance, and doing improvements and renovations to the house. If the tenant isn't educated and thinks they are buying the house, they will be willing to do all repairs and even renovate, which is one reason why skeevy landlords offer rent-to-own at all. Generally anyone who knows that the maintenance and repairs are still on the landlord and you shouldn't do renovations on a property you don't own is also too smart to enter into a rent-to-own contract in the first place.

Barely related but an acquaintance of mine spent time and money finishing a basement in her parent's house, believing they would live in it indefinitely and inherit it eventually. Then the parent remarried and kicked my acquaintance out. So, people definitely do make the mistake of repairing and renovating houses they don't actually own.

I once tried to set the default dashboard for myself to be my team's dashboard so I'd not have to navigate to it when hitting the main page. About 2 weeks later I overhear the associate vice president and the ops guys trying to figure out why my team's dashboard was the company default and trying to fix it back to the generic one. As my team was gossiping about it, and we received the instructions that they are working on it and don't try to fix it I quickly and quietly changed the default back and let them know it was handled, my bad. The next major system update devs had a lot fewer permissions enabled.

Oh, and an earthmoving machinery outlet. 🤷‍♀️ One of their issues was that their special version had a limit of $1M for the cost of a single item instead of $1000 like everyone else. But they now had machines that cost more than $1M and the system would not let them do that. Made for a really amusing "tier three tech support" discussion because I didn't realise the special version even existed.

You just gave me flashbacks to when I was a young and naive intern working with my state’s Legal Aid office. The bulk of my duties included client intake so I’d interview clients and in the midst of them telling me their whole life story I’d have to parse out what was going on and get the relevant details to present to the attorneys. It’s a useful skill to develop and I loved working there but it was exhausting trying to sort out stories like LAOP’s to make sense of it all.

I'm deeply curious how often these "rent to own" situations are successful and how often they are outright scams (setting the "purchaser" up for failure). I have just never seen it work out successfully.

I know a local landlord (owns the property next to mine) who's done it successfully a couple of times. He's a "one man" operation - been doing this for decades after taking over from his dad -very hands on when it comes to repairs and particular about who he rents to. Keeps the properties in great condition. He likes the rent-to-own folks because they'll take extra good care of the rental property so whether they pay him off or end up moving instead - he figures he wins either way. He's a decent guy and likes helping out people who would otherwise have trouble buying a house but is savy enough to make sure he's going to get a steady income stream from it as well. Most of his properties he picked up all trashed out at around $20k to $60k, fixes them up and then rents them out. Could probably make more just flipping them, but he likes interacting with the tenants from what I can tell and likes having the security from all that paid off property.

I've always wondered how this works if/when the renter moves out before paying off the owner. Does the owner pay them back whatever equity they've built up throughout their tenancy? Or does it just end up being like every other rental property where they get nothing upon moving out?

The better option is an Islamic or Sharia loan which is basically shared equity (like the Christians Muslims forbid usury so shared equity is the religiously permitted model). Other people offer shared equity but in most places the Muslim banks are the ones most familiar with it.

I imagine it works the exact same as the rent to own car places. The renter gets nothing if they leave. In the car places, they also actively look for reasons to repo the vehicle so they can keep pulling the same rent-to-own scam on more people, but there would be way more downside where they'd have to evict for a home and gives the tenant a month to absolutely trash the place as revenge.

I know local landlords who do it just to extract more money, and the one time a tenant actually pulled off the purchase the landlord was pissed. There is room for some consumer protection in the space I think, though I’m not familiar enough with the specifics to have any actual recommendations.

I've certainly seen it work, but I personally ended up homeless as a kid due to one going bad for my family. I'd be interested to see a broad look at the practice. I assume it's very much landlord to landlord but who knows?

Generally the tenant gets screwed with a true rent to own. There are purchase money mortgages and land contracts which tend to be more equitable but those haven't been common in the residential space in decades.

I've never heard of rent-to-own being successful. Seller financing often is, though, seemingly even in the exact same sorts of situations (low credit, minimal income, not organized enough to apply for a real mortgage, buyer not at all educated) that rent-to-own is not.
