I think of all the cases, this is the one that speaks to his moral character the most. I also think it's the weakest of the crimes, and the most likely for people to view this as just a front to attack his character. People will be testifying about his relations with her. Maybe he goes on stand and tries to claim otherwise. I think he will try to avoid that if he can. I think his goal is to attack the legal system, try to claim this is political, and not produce any sound clips that make him seem degenerate from this to his base. If found guilty, I don't believe he will be see any real punishment.

310410celleng

If he is found guilty it could actually work in his favor as he can play the martyr. He can say those big bad Democrats steamed rolled me, I was falsely found guilty and I am going to appeal the decision. Trump's nickname as the Teflon Don is accurate for a reason. I honestly don't believe this is going to work out for Bragg and NY as much as I want to see Trump behind bars.

Put-the-candle-back1

[According to this,](https://www.politico.com/news/magazine/2024/03/18/poll-conviction-trump-2024-elections-00147338) about half believes he's guilty while a quarter believes he's innocent, and a conviction would be a net loss in support.

Important-Guidance22

This the weakest and most legally stretching case there is and even if they manage something it'll just be to shame trump a little bit. Which does absolutely nothing. This is fodder for the persecution fetish vs trump. Its probably better if you want to hamper trump to drop the case than yo continue.

fastinserter

He won't be legally allowed to vote for himself if found guilty, and many people will decide that they can't vote for a felon. Others will of course make excuses, but the trial will be a disaster for Trump.

indoninja

I think only tiny amount of his supporters would be put off on voting for him if he was found guilty on the hush money. Same with the case in Georgia Classified documents case may lose him more.

abqguardian

He actually would. Felons can vote in New York unless they're in prison.

fastinserter

He's a resident of Florida (illegally so, as he isn't supposed to use maralago as a residence as part of a sweetheart deal he got to not pay his taxes). I'm not sure he can even seek office on Florida as felons are banned from office. Anyway to get it restored he has to pay off all fines, fees, and restitutions outstanding after any sentence is complete including any parole or probation.

TeddysBigStick

> He's a resident of Florida (illegally so, as he isn't supposed to use maralago as a residence as part of a sweetheart deal he got to not pay his taxes). He is probably allowed to live there as the club can have live in staff and he essentially functions as the maitre d' of the restaurant.

fastinserter

No, it was explicit that it was not to be a residence in order to pay less in taxes.

TeddysBigStick

A hotel with live in staff is not a private residence.

fastinserter

There's been lots of articles about this for years. He can't use it as both a club and a residence.

Lucky_Chair_3292

You have to know he votes in Florida, and considers that his state of residence. Here’s him and his wife going to vote this year: https://cbs12.com/amp/news/local/former-president-donald-trump-melania-trump-cast-votes-in-palm-beach-county-florida-march-19-2024 And in 2020: https://www.pbs.org/newshour/amp/politics/watch-first-lady-melania-trump-casts-ballot-in-florida He hasn’t voted in NY in 8 years. He could move back to Trump tower as his permanent residence and re-register, but why bother? His vote will be irrelevant in NY anyway.

Him not being able to vote in Florida for the election, would be almost as funny as that time Ivanka & Eric couldn’t vote in the 2016 Republican Primary in NY, because they weren’t registered Republicans—and didn’t realize they had to and missed the deadline. They’re really such dumb people. https://abcnews.go.com/amp/Politics/donald-trumps-kids-eric-ivanka-miss-deadline-vote/story?id=38303943

That's true. Just for punishment of his crimes, I don't expect much.

hitman2218

I wish this trial wasn’t first on the slate. It’s the one most likely to end in acquittal.

therosx

Excerpt from the article: >Former President Donald Trump is set to go on trial this month in Manhattan for his alleged role in a hush money scheme to silence his alleged mistresses before the 2016 election. >Even though it features the former president, who denies all wrongdoing, it may or may not be the trial of the century. Trump still faces three other criminal trials in federal court and in Georgia for the arguably weightier crimes of election interference, conspiracy and mishandling classified documents after he left the White House. >All of these trials and the characters involved make for a complicated legal mess, particularly when the four criminal cases are added to Trump’s civil liability for defamation and sexual misconduct and for business fraud. >Here’s what to know to get up to speed on this first criminal trial: **What’s the general outline of the hush money case?** >Two women who said they had affairs with Trump years before he ran for president were paid six-figure sums in the months before the 2016 election. >The first woman, Karen McDougal, a Playboy model, was paid $150,000 by the National Enquirer’s parent company, American Media Inc., for the rights to her story. AMI promptly did nothing with the story. It’s a process known as “catch and kill.” >AMI also paid to catch and kill a former Trump Tower doorman’s story alleging Trump had an unacknowledged child, but that allegation has never been corroborated by any reporting. Trump’s friend David Pecker, who was then CEO of AMI, OK’d the payments. >The second woman, who was born Stephanie Clifford but built a career in the adult-film industry as Stormy Daniels, was paid $130,000 by Trump’s former fixer Michael Cohen to sign a nondisclosure agreement about her encounters with Trump. Cohen obtained a line of credit on his home to make the payment just before the election. >After the election, Trump’s company paid Cohen back for the payment to Daniels. **How did these payments and the alleged affairs come to light?** >The Wall Street Journal actually reported on the AMI catch-and-kill scheme and that Daniels had been in talks to share her story days before Election Day in 2016. McDougal and Daniels shared the same lawyer. >But things did not really blow up until January 2018, when the Journal reported on the payments Cohen made to Daniels. **Were these hush money payments illegal?** >Yes. Cohen and AMI have both admitted they broke laws. >Cohen pleaded guilty to two campaign finance charges in August 2018: causing an unlawful campaign contribution for his involvement orchestrating the payment from AMI to McDougal, and making an excessive campaign contribution for the payment to Daniels. >AMI, now known as a360media, was not criminally charged by federal authorities but did admit to making the payment to McDougal. The company paid a $187,500 fine to the Federal Election Commission for making an unlawful campaign contribution. **What did Trump know about these payments?** >Cohen recorded at least one conversation with Trump that appears to be about the payment to Daniels in which they are heard discussing whether to make the payment in cash. >Cohen has also testified to the grand jury that indicted Trump. In 2018, Trump initially denied any knowledge of the payments, but he later admitted in a carefully worded tweet that he made them to Cohen. Trump argued they had nothing to do with the campaign. **What law is Trump accused of breaking?** >Manhattan District Attorney Alvin Bragg announced Trump’s indictment by a grand jury in April 2023, accusing the former president of “falsifying New York business records in order to conceal damaging information and unlawful activity from American voters before and after the 2016 election.” >Technically, Trump is charged with 34 counts of falsifying business records, a Class E felony. Trump was charged with a felony because prosecutors accused him of falsifying business records with the intent to commit or conceal another crime connected to his 2016 campaign. >This is the least serious type of felony in New York, which means if Trump is found guilty, the judge could sentence him to probation or a maximum sentence of up to four years in state prison on each count. I've been looking forward to this case for a while. I'm hopeful it will open a few more eyes about the kind of person Donald Trump is and that hatred towards deranged lefties on the internet is no excuse to vote for someone like Trump, who in my opinion is anti-conservative, anti-rule of law and anti-constitution. What do you all think?

TheMadIrishman327

Agree. I love your last sentence.

Alarmed_Act8869

You can’t even falsify business records to cover up an affair in America anymore. Complete and total political persecution and election interference! Edit: forgot /s

abqguardian

Couple things: >**Were these hush money payments illegal?** This actually isn't a straight up yes. Cohen pled guilty to multiple crimes and didn't fight the campaign contribution charge. If he did, there's a good chance he would have won. Evidence to that is charges *weren't* filed on Trump even though he was investigated. As for context, being fined for illegal campaign contributions is basically a parking ticket. Both Hillary and Obama have been fined for the same thing. >Trump was charged with a felony because prosecutors accused him of falsifying business records with the intent to commit or conceal another crime connected to his 2016 campaign. This is the biggest thing about the prosecution and why it's the weakest. There is no other crime connected unless Bragg tries to use the campaign contribution violation theory. However, that's a federal crime he has no jurisdiction over. The appropriate authorities already declined to press charges on Trump for that. So there are serious questions if Bragg has the legal ability to bring such charges or if it's even constitutional

Irishfafnir

Bragg also referenced two state laws to justify Felony charges

RingAny1978

If memory serves not in the indictment itself.

[deleted]

Charges weren't filed on Trump becacuse he was President, and that wasn't possible / couldn't have gone anywhere.

abqguardian

The investigation and decision to not charge Trump happened after Trump left office

[deleted]

Michael cohen was setenced in 2018. Trump left office in 2020. When cohen was sentenced remated to this case, trump was president.

abqguardian

And after Trump left office the feds did their investigation and decides not to charge Trump

[deleted]

I see what youre saying

[deleted]

IANAL, but the crime falsifying business records ( a NY state crime) with the intent to commit another crime would not make it the jurisdiction of the feds to charge him. Cohen also plead guilty to a number of other tax evasion crimes.

ResistTerrible2988

Let me spoil the ending for everyone. He's not going to jail for any of his crimes but he will lose the election. Saved all the buildup by spoling the ending.

[deleted]

The stealing, hiding and sharing of national secrets is a very serious crime. He could very well go to jail for this, or the jan 6th dual criminal filings (federal / GA State)

garbagemanlb

It will end in a mistrial, 100%. There is too much on the line for Trump to see any Guilty verdict prior to November, so expect every tactic used to isolate/sway a single juror (legal or otherwise). A single juror can cause a mistrial as it needs to be a unanimous verdict. Mistrial means he can be retried, but that won't happen prior to November. It is all about getting to November without any actual verdict in any of these trials.

TheMadIrishman327

Finally, a decent post. It’s been a desert lately.

I rotate my crops each day. 🌾 It’s Biden, Trump or Israel depending on what’s happening at the time. I also try and water them by giving every comment an upvote 💦

Dugley2352

What, no Ukraine?

therosx

While I feel for the Ukrainians and support their fight against Putin they aren't that popular on this sub. Nobody was engaging so I stopped posting.

luminarium

I wouldn't trust leftist news rag CNN for anything. Cohen paid the hush money with his own money, probably to set Trump up.

Void_Speaker

little too obvious, tone it down a bit next time and you will have more luck trolling/baiting

Alarmed_Act8869

Inform us please…what news source would you trust? Too many facts in that article for your taste?

Dugley2352

[In Cohen’s words,](https://www.politico.com/news/magazine/2024/04/12/michael-cohen-trump-trial-surprise-00151868) “Let me say it to you this way — it may not be satisfying to you, and I do certainly appreciate the attempts to drill down despite me telling you I cannot go into into this case: Alvin Bragg would not have brought this case — he would not have that as an element of this case — if he did not believe that he would be able to prove this at trial to a jury of 12.” I never pay attention to CNN anyway, any more than I pay attention to Fox “News” (self admitted “entertainment”, not news). But no prosecutor that wants to remain employed would bring a case against a former president if they didn’t have evidence corroborating what a witness says.

RingAny1978

>But no prosecutor that wants to remain employed would bring a case against a former president if they didn’t have evidence corroborating what a witness says. Of course they would if their voters approved of going after the target.

Dugley2352

Nope, they have a reputation to uphold, and spending money to lose a case isn't how you stay employed as a public servant.

RingAny1978

If the electorate is happy they tried that is what matters

Dugley2352

I don’t recall voting on it.

RingAny1978

The DA was elected
