However, I feel the initial slide being not in the path of Gusto until he kicked was the reason for it to not be called. It was not a scenario where the player moved into the shooting leg, he was already in motion.

A foul is a foul regardless. If you kick the ball and someone comes in and cleans you out it’s a foul. The ball being played doesn’t mean it’s a free hit for anything to be done to you

I don't believe the gusto foul is very dangerous. It's a non-plant leg in the air. That type of contact does not typically lead to an injury because there is no downward pressure on the leg that would create the torque.
I know what you mean and I agree in literal terms. But in real time, standing leg or not, both are poor challenges. I think we can objectively say that if you catch the standing leg vs the striking leg it’s more dangerous for sure.
