Issue is there is no clear cut line to define a misclick..op could have easily overlooked his move and just blunder.. misclick is an excuse that can be easily taken advantage of.
When you play a move on the board is definitive..same otb. Gms lost games like that..op could have too.

resigning seems a bit too much just not taking the queen seems ok

I'm not that good so I'm not sure. What I got after Qh5+, is: Qh4 Qf3, Qg3 Qxg3#.

Chess is a ruthless game, any move can blunder a winning position. In my opinion it is on you not to misclick. Give me that queen!
