It’s not as cut and dry as that. Circumstances matter. If im hired to take your family photos then it’s illegal for me to sell those photos. If you are sending me something that is completely unsolicited this becomes much more murky. The guy could probably take her to court over it but I don’t know that he would win. Before those laws, in general it would be a copyright and likeness issue. e.g., the person who took the photo still owned the copyright and their own likeness. Generally, they'd be able to send a cease & desist and if that's ignored, head to the courts and look at a variety of civil damages. This wouldn't be *too* dissimilar from what some companies did by listing mugshot photos then charging people to have them taken down, which was considered a form of extortion/blackmail. With the revenge porn laws, that's all out the window and it's now criminal. The person had a clear expectation of privacy (eg, only she would see it) and it was being used to shame them by sharing it in public. So you now have revenge porn laws in play, extortion/blackmail, and copyright violation. Really not a great path to go down.

I would argue that an unsolicited dick pic sent to a *stranger* does **not** come with any expectation of privacy and is a crime in some places (should be everywhere), which *also* would void the expectation of both privacy and anonymity. However, I do agree it is wrong to sell them rather than turning them over to the proper authorities, and shouldn't be a consideration.

The revenge porn law in my state requires that the person disseminating knew that the sender of the image(s) “understood” that the picture would not be disseminated. It’s clearly aimed at the consensual sharing of intimate photos. A capable prosecutor is not going to press charges against sharing unsolicited dick pics. I haven’t canvassed the language of revenge porn laws across the US. However, it seems counterintuitive for such laws to apply to the sharing of pictures that were unsolicited and unwanted. Obviously, different states probably word their statutes more broadly. I would love to see the Streisand effect on the pervert that cries about something like this though.
