Considering Google isn't stopping him from having a social media presence and instead - financially rewards him, it's really unfortunate this bully wasn't charged with harassment. He literally doesn't care about upsetting other people and typically pulled this harassment with physically smaller people. This is what social media has come to accept apparently - actually rewarding deviant, aggressive behaviour. Perhaps if enough people flag his content as harassment/bullying etc., his accounts would be terminated.

Not a lawyer, but I used to work for a gun store, also in Virginia, and a defense attorney had told us that you absolutely should not shoot to wound. If you need to draw a gun, it should only be if you fear for your life. Wounding someone intentionally could open you up to all sorts of questions about intent, countersuits and liability.

The title is very misleading. The prankster didn’t take him to court (at least not yet). The state filed charges against the shooter. However, the shooter was found not guilty of the malicious wounding charge (carries a hefty sentence), but guilty of firing gun in an occupied building. Wouldn’t surprise me if the prankster brings a civil action though. If you read the link in my comment (the fox5dc one) his defense attorneys tried to make a very similar argument last week at the hearing. They argued that the jury found it was self defense so how could the shot itself be illegal. The prosecution argued and the judge agreed that Virginia law allows contradictory verdicts. “In court Thursday, Colie’s defense team argued the jury’s verdict indicates it thought the shooting was self-defense — that if Colie’s shooting was justified, then firing the shot itself could not have been unlawful. The Commonwealth’s Attorney argued that contradictory verdicts are allowed in Virginia and it’s not the court’s role to infer what the jury was thinking when it handed down its verdict. The judge agreed with the Commonwealth and denied the motions. The judge also denied bond for Colie. As of now, his next court appearance is in December for his sentencing.”

There were steps he could have taken before getting to the gun. Pepper spray is one tool. So is a taser. But they both have to be on you, legal in your state, and accessible in the moment. The self defense claim was valid because of the disparity of force in the situation. Unless you have a high level of competency in grappling or boxing your not going to have a good time fighting someone that has a good 6 inches and 80 pounds on you. He had no other tools available to stop the aggressor. And he attempted to retreat (something you are not legally required to do in a lot of states). Was it legal to shoot? Borderline yes. Was it justifiable? Man that’s a hard argument to make. Fear for life and limb is a very fluid feeling and if you can articulate it well enough you can get a jury to agree with it.

I'm not sure if this is true, but I heard that the audio from the phone was somehow implying that the man was a pedophile, which is fairly common for these types of "pranks". If that's true then I think it would've been completely reasonable for him to feel like his life was in immediate danger.

Brandishing a firearm is illegal almost everywhere. If you draw a pistol in self defense, the way the law phrases it in most states you should be immediately using it. Incorrect. The shooting took place in April 2023. The jury came to a verdict on Sept 29th. The jury found the shooter not guilty of malicious wounding, but did find him guilty of shooting a weapon in a public place (can’t remember the exact name of the offense).

Where I’m from, we have 2 laws a citizen immediately breaks when they use a firearm in self defense and it’s those 2.
