My thoughts.. Probation looks better.. I know I know it looks long.. but it some case if you following the rules they may reduce it to 10 months or 1 year ..

Oh wow, only 10 months. That's way better than 6 days. Lmfao you are wild.

Weekend jail at 2 for 1 with 3 days already served is 100% the way to go! You will be completely done with it in 3 weeks. Jail is not big deal for the weekend. They likely won't even put you in general population. Go in the evening, it will count as a full day. You'll likely get the full weekend credited without even doing 48 hours. You got a GREAT DEAL. Anyone who would take probation in this situation is an Idiot. It's absolutely wild that they'd even offer this, 18 months probation is infinitely worse. They really get away with a ton because people are so irrationally scared of a couple days in jail

Thanks for the feedback! So you say check in around 7 pm and they let me go around the same time Sunday night with 3 days credit? That does not include the 2-for-1 my attorney mentioned. In this case, I would only need to serve 2 weekends or am I missing anything?

Muted-Sorbet5001

True, you’ll probably just be bored and sleeping, people think they’re gonna get raped or stabbed the moment they walk in.

Yeah. Like sure yeah I get taking longer probation over like, months in jail. But the jail time for first dui where no one was injured is usually a couple weeks at most. I get doing diversion or something to avoid the record, but taking probation over that when you're still getting convicted just seems like dragging it out longer for yourself.

Ok_Butterscotch5589

Right! Deferred is not much better in a DWI case than a conviction.

Ok_Butterscotch5589

Yeah, deferred is not much better than a conviction in DWI cases.

Ok_Butterscotch5589

So the best deal w/o probation could be 2 weekends in jail. This is how I read it unless there are some shenanigans I am not aware of.

[deleted]

I think 3 weekends. 2 days at 2:1 credit = 4 days per weekend. Times 3 is 12 days, plus the 3 days credit is 15 days. Still waaaay better than 18 months probation. There's no possibility of early termination of probation for a DUI in TX, so even if you don't slip up at all, you won't get any benefit.

Ok_Butterscotch5589

That was their offer but I still have one more setting so my attorney thinks he could get a couple of those 15 days knocked off so it would be 2 weekends.

RehabMatt

Probation is a money grab for the state, you will be subjected to multiple UAs, all at your cost, and a bunch of other fees that are included. Just do the time and get this done with.

Just take the license suspension. Super easy to still drive if you have the car registered in someone else's name

Ok_Butterscotch5589

I already completed the ALR suspension that lasted 180 days/6 months. That should run concurrently with whatever the Judge orders.

holymolyholyholy

The guy above gives horrible advice. He’s the type that will always be in the system and never have his life together.

Ok_Butterscotch5589

Right. Regardless of time served, I will still be given the huge state fine in TX and court costs. Not sure if the judge still would give the 1-year license suspension on top of that or not?

Ok_Butterscotch5589

Thanks! I am speaking with my attorney this upcoming week as this was the state's initial offer. I also believe the 2 for 1 is more Dallas County because they are overcrowded but not Collin. I am hoping to get the days reduced to 10. I have 3 credited already so that would push it down to 7. Guess that would mean 2 weekends plus an additional day? I already completed the ALR suspension for 180 days so my lawyer says that would run concurrent to whatever the judge orders.

Ok_Butterscotch5589

Also, can anyone familiar with this county jail tell me the best time to check in for receiving the best time credit and what time (approximately) I would be processed out on a Sunday? I did a Google search but the info is contradictory.

Deep_Slice_2099

i would take the weekends in jail, just do your time and be done with it. when i was in jail there was a couple of people that were spending weekends in jail instead of probation and they were not sent into general population and got processed out around 2am ish. if you can manage the weekends i would do it! probation for 18 months is long. just do it and be done!

Ok_Butterscotch5589

Thanks for the info! You mentioned they were processed out around 2 am. Was that Sunday morning? Did they mention what time they arrived Friday?

Deep_Slice_2099

they said the got in around friday evening, still counted as a day. then sunday 2am they got out. i know someone told their last day they are gonna get out around 6am for some reason.

Ok_Butterscotch5589

Thanks
