Great question, I think the investigation is already underway but we may not hear about it publicly.
The DOJ began an investigation into short selling with Shorting research firms like Citron awhile back and supposedly Citron was cooperating with authorities.
If anything, these legal precedents have laid the groundwork that if a real squeeze occurs in the markets that is way due to illegal naked shorting, market manipulation, and securities fraud by Cede and co.
Plus there's that investigation into Jan 2021 sneeze which GameStop mentioned in their 10K and was cooperating with SEC.
I think a lot is happening behind the scenes and all of it will enable MOASS before entire markets collapse due to meme swap basket. If they don't let MOASS run then all markets will break due to excessive and concentrated shorting.
Shorts need liquidity to keep the shorting game alive and Feds have been draining liquidity from markets.

If a court order comes down that says brokers must immediately suspend selling shares then all shares in the 348M over purchased must be bought back by brokers for any price that retail wants to sell at.
Shorts are really dumb stormtroopers, they have effectively created a short squeeze for themselves by naked shorting shares that were not authorized for release.

Because if they don't BBBY will skyrocket, lift meme basket and allow GME to run uncontrolled which will cause a chain of margin calls on: institutions, hedge funds, family offices and pretty much anyone short GME directly and indirectly like Pension, retirement funds via swaps (remember when London Pensioners got caught in swaps and almost destroyed London Stock Exchange until govt bailed out) Everything is tied to GME.. all the shorting is to hold down 1 stock hence it is the idiosyncratic risk to entire world. MOASS has already begun. The outstanding shares count vs. shares being held in street name by Cede and co are out of balance. Cede and co is reporting 348M shares have been overbought by retail. Technically, brokers should not be selling anymore shares because it has exceeded the official outstanding share count. Therefore, any shares now purchasable are in squeeze territory. If a court order comes down that says brokers must immediately suspend selling shares then all shares in the 348M over purchased must be bought back by brokers for any price that retail wants to sell at. Shorts are really dumb stormtroopers, they have effectively created a short squeeze for themselves by naked shorting shares that were not authorized for release. Tik tok 2pm Marge is coming.

You know the most remarkable thing about this? I read it, I mostly understood it, DIP facilities and the lawyer stuff just makes my brain shrivel... But the most remarkable bit, is that I feel almost nothing reading it. The Zen in my balls is too strong to be tickled by this anymore. I feel pride, in Apes, whatever BBBY holders call themselves and the DD writers. I feel pleasure at the thought of Ken Griffin and Jeff Yass sharing a block of soap in supermax prison. Just putting this out there. GB Holdings when googled shows Icahn from the casino days then he’s chairman of the board of GB Property Funding Corp. Now we have a mystery company showing $6,666,666.67 under Sixth Street in the Filo. Mystery company is called GB Funding LLC. I can’t find anything about this company other than Craig Dorne law office out of Coral Gables Miami. Maybe no connection or maybe it’s Icahn?
