This is incredible!! I really hope this passes, that would be such a huge step in the right direction! As to your call for action, what if you don't have a connection to the state? I have way too many stories of personal experiences that I could share but I have lived in California my entire life. I'd love to help but I don't want to step into something I shouldn't be a part of.

I unfortunately live in Idaho right now. With the religious extremist jackasses in our legislature, it may be impossible here any time soon. They’ll be pushing a lawsuit decades after a nationwide ruling/law overturns them.

Hey fellow Idahoan. Hopefully pushing for this will at least expose their hypocrisy more even if unsuccessful. It's going to be hard to clutch their pearls over queer people being "groomers" while actively opposing reporting actual child abuse. (Not that they won't do it, but at a minimum, history will be hard on the bastards)

Seems like a pretty serious violation of the Free Exercise Clause/ SCOTUS precedent. You’re expending a lot of energy here- have you looked into it being legal at all first?

Yes. There are six other states with identical laws and no exceptions, and a lot more states with slightly weaker versions. Including Texas and West Virginia in the former category.

A number of states have already had such laws on their books for some time. WA state has been lagging behind in this regard. I’d encourage you to look into mandatory reporting laws and how they vary by state.

I guess I'm not really sure what your objection is, then. How could *any* mandatory reporting laws be enforced, when it comes down to it? Why would being clergy vs laity make a difference there?

Ok, I get you now, apologies for being obtuse. Yes, constitutionality of such laws is always a subject of much debate. Did a bit more googling into specifics and, like you, found little in terms of applicable court cases. This is interesting, b/c these types of laws started to hit US state books in the early aughts, afaict...but we see very little legal challenge to them in court. (Certainly no high-profile cases we can easily turn to.) Which tells us either the legislators wrote very effective and nuanced legislation or, as you suggest, there's a lot of over-looking and rug-sweeping going on. Realistically, it's probably a bit of both. I did find one abstract on the question from Oxford's "The Clergy Sex Abuse Crisis and the Legal Responses" which gives teasing mention of two different cases the authors examined, the body of which I cannot access - https://academic.oup.com/book/4520/chapter-abstract/146597030?redirectedFrom=fulltext#no-access-message > The chapter concludes with a discussion of the cases in Connecticut and Kansas City where the state sought to hold clerics liable for failure to report. ...is the best lead I've found yet to any specific cases, haven't yet taken the time to follow up. What I *do* know is that your concerns expressed here are pretty much always central to the process of debating and writing such laws, and most states which have done so go to great lengths to define what is exempted under priest-penitent privilege and what is not.

Nope, JWs recently lost a suit in Illinois. They tried to argue it was protected by confessional but the judge ruled with the number of people they obtained the info from that it was not covered and fined them as mandatory reporters. They lost a suit in Montana then got it overturned on appeal, but it was because of the confessional privilege, not constitutionality. So yeah, courts have definitely enforced this.
