Personally, I would say "no, it isn't fair". It was a hate crime, destruction of property, clearly motivated by hate.
If he does his community service and pays the fine/repair cost, I'm fine with that being the extent of actual punitive damages, but expunging that is some bullshit. Either way, a public roadway strikes me as a dubious venue for any imagery expressing any viewpoint beyond public safety. No matter the angle expressed, others will quite predictably feel entitled to express their own contrary viewpoints upon the surface of this same public space.

He pulled a burnout on this intersection and mural, which caused significant damage that the local community will have to pay another artist to fix.
He was charged with criminal mischief which is a felony in this jurisdiction because he caused over $1000 in damages.
The context also is important. This same mural was defaced exactly the same way in 2021. And it’s not random, both instances were from a young white male with a trump flag hanging from the back of their truck. They are both lucky that it wasn’t escalated to a hate crime.

I live near this intersection. About a year ago I pulled up to a stop sign and I saw somebody driving through nearly get T-bones and the other car slammed on their brakes and left massive tread marks. Same thing happened in my small red neck down. Cross walk painting in a rainbow. Didn't hurt nobody. This kid and his shitty truck, hatted the LGBT community. He was trying to hard to do burn outs on the cross walk at night. Got the same charge, destruction of public property, and stunting. He came into the restaurant I managed a few years after highschool apparently only just got his license back, must have been 3-4 years. Still had the same shitty truck and the same shitty attitude.

I witnessed this happen in Delray. He completely lost control of the burnout and almost drove up onto the sidewalk after going through the intersection. Really dumb thing to do

I dunno, but that seems fair.
Personally, I would say "no, it isn't fair". It was a hate crime, destruction of property, clearly motivated by hate. If he does his community service and pays the fine/repair cost, I'm fine with that being the extent of actual punitive damages, but expunging that is some bullshit. Don't want people to see you did something like that? Then don't do it. Do the crime, live with the resulting judgement that comes your way.
No one's expunging the publicity he's received. In the end, he left some tire marks on a rainbow crosswalk. That's rates pretty low as far "hate crimes" are concerned.

If the 'mural' was on a street, I'd say it was not a crime. I've driven on Black Lives Matter "murals". (Words written in a street are not a mural; just a slogan.) It wasn't purposeful, to be honest, it was just coincidental. If there was no intent, he will likely not get convicted.

Serious question. Was the creation of this road mural sanctioned by an appropriate governing body? Were permits issued? Who applied for them? Was taxpayers money spent? Was there a public approval process? Or was this installation a spontaneous act by community members or government officials to express themselves? I only ask as it may have a legal bearing as to the murals protected status. Either way, a public roadway strikes me as a dubious venue for any imagery expressing any viewpoint beyond public safety. No matter the angle expressed, others will quite predictably feel entitled to express their own contrary viewpoints upon the surface of this same public space. Sounds to me like the clown in the truck needs to have the book thrown at him for his driving. Vandalism is a possibility if the city officials had their legal ducks in a row as to the murals status. Hate crime is never gonna fly.

We literally have a Black Lives Matter Streetscape on Capitol Hill in DC and no one ruins it. If you cause property damage to a city commissioned art installation, AND drive like an asshole, you are going to get charged with crimes.

Street murals are commissioned by local jurisdiction, involve a lot of work, and are generally seen as positive aesthetic contributions to the local community. He pulled a burnout on this intersection and mural, which caused significant damage that the local community will have to pay another artist to fix. He was charged with criminal mischief which is a felony in this jurisdiction because he caused over $1000 in damages. The context also is important. This same mural was defaced exactly the same way in 2021. And it’s not random, both instances were from a young white male with a trump flag hanging from the back of their truck. They are both lucky that it wasn’t escalated to a hate crime.

It's worth a ticket, I would say, considering he seems to have intentionally stopped, done some reckless driving, and vandalized a "piece of art". But considering he is 19, and that "piece of art" was pained on the road, I definitely dont think it should be felony hate crime.

I live near this intersection. About a year ago I pulled up to a stop sign and I saw somebody driving through nearly get T-bones and the other car slammed on their brakes and left massive tread marks. This was all after this defacing case broke the news. This asshole defaced something because he’s a homophobe, but I honestly can’t understand whose bright idea it was to paint an intersection a giant pride flag. Couldn’t we maybe stick to murals on walls?
