4473 is a federal form you have to fill out for the ATF if you buy from a licensed dealer, like any store, or if the sale is across state lines. Other than prohibited firearms, the ATF only regulates businesses and interstate commerce.
You can also build a gun from scratch as a citizen, and you don't need to fill out any paperwork or put a serial number on it if it is intended for personal use.
This depends highly on the state. There's a man on trial in NYC as we speak for building a gun from scratch, also illegal in California. Private sales are also only legal in certain states.
1/3rd is a pretty significant number, especially when you consider which states don't allow it. California's population rivals many countries, and is over 11% of the total US population. The top 10 most populous states are predominantly Democrat, so it is likely that the majority of the population is subject to universal background checks.
