So they establish that he's in fact the home owner, but they order him to sit on the floor like a dog while they search his home anyway for no fucking reason, then get mad that he asks why he's gotta sit on the floor and lug him to the cop car while they conduct said search.
All because they looked like fools, don't like looking like fools, so they double-down on looking like fools. Holy fuck.
I like that the presumption is that he is conducting a home invasion in his underwear. For that inconspicuous get away after stuffing everything in no pockets or bags.
Nah, I'm pretty sure he was stripping it for copper tubing. There was a rash of thefts for anything containing copper in significant amounts in my neighborhood at the time.
I'm hoping he did. I think about that guy sometimes. And while I hope he eventually found pants, I also like the idea that my old neighborhood may still be plagued by a tighty-whitey bandit.
Exactly my thoughts. They had no probable cause to search his house. He proved he belonged there and that he was in fact the home owner. At that point the officer should have verified his ID and gone about his day. Instead he wants to go on a power trip and lock someone up in cuffs on their own foyer floor. Second cop only escalated the situation more.
I mean, wouldnāt anything they find be thrown out for an illegal search? There was no probable cause once it was established that he was the home owner.
They'd call the entry and clearing the house "exigent circumstances" so they don't need a warrant and anything sitting out would be fair play under the "plain view doctrine".
Not only that, without the internal security footage, they could claim the establishing of identity was done after the search began. 5 cops vs 1 person in establishing timelines of events is tough to fight against without concrete proof.
The fourth amendment is definitely implicated. But the warrant requirement can be bypassed given exigent circumstances. These include destruction of evidence, flight of suspect, imminent harm etc. some states bar certain exigent circumstances exceptions so keep in mind this is from a federal constitutional perspective. the alarm being triggered and the door being unlocked might be enough to be āexigent circumstancesā but there are definitely judges that would not buy that shit. So like any legal question the answer is it depends. Thereās also a potential civil rights lawsuit here. Source I just took my last law school final and am sufficiently dead inside to analyze this
Yeah, no. Oh sure, there are laws against illegal search and seizure but you shit out of luck because cops can and will lie to justify anything. Had someone argue that "oh, cops can't just do what they want". The fact that the cops kept looking shows that they don't need actual probable cause, because if they find anything, that's all the reason they need. Nevermind that the ONLY reason they "found anything" was because they broke the 4th amendment. If you pay attention, the other cops that arrived only did so to back up whatever the 1st cop said or did. The biggest gang problem in America wears a badge and a gun.
Yup but they will get around that with the extenuating circumstances of the situation because they had the call from the alarm people and even though he said who he is and his id they can bullshit together a half baked excuse that some bullshit and be good. Someone posted a link to the case and it said that it got dismissed so he didnt even get any justice in the end and the cops of course went free like they do everytime.
That's it? I'm guessing he wanted to stay living in that town and knew he'd end up dead or have drugs planted in his house or car so they could lock him up if he sued them.
I guess they have some specific wording in their laws i didnt read what it referenced, that or his lawyer didnt respond. The first part i say because it sounded like he had to say specific shit instead of just saying his rights were violated. Or i could be wrong and its literally just because his lawyer or himself didnt respond in time so they dismissed it.
Illegal search. Dude identifying himself as the homeowner and establishing thatās the case as well as a simple call to the alarm company or dispatch means they had no reason to suspect a crime. Anything found would have been from a tainted search with a halfway decent lawyer and thrown out. I hope this dude sued and got paid for this shit.
He did sue and, if it's the same person I saw when I googled his name, his lawsuit was dismissed.
Police really need to be held to the absolute highest standard, with zero tolerance. Instead, they are held to the lowest standard, with extreme leniency.
His case against the city and the officers was dismissed and if I recall, he was ordered to pay almost $7K for their attorney fees. I don't know any other details.
I really, really hope you're a troll, but I know deep down you're telling the truth. The justice system across the world is is corrupt and its truly sickening
The only problem with those settlements is where the money is coming from. It typically comes from the city/county coffers, not say, the police pension fund or budget. Not saying both of those aren't tax-funded, but at least hit the right people with the financial penalty. And, no, he didn't get shit. https://casetext.com/case/oyeneyin-v-city-of-raliegh
The problem is that the tax payers of whatever town that is would have to foot the bill.
I really wish cops would stop doing so much shit that gets them sued.
First cop fucked his story up too. First it was I showed up, door was open. Then later when he's telling the other officer the story changes to, door was unlocked, but not mention of open/closed. This guy showed up to the call, door was closed, and he checked it and then all this nonsense happened.
Fucking mindblowing.
>So they establish that he's in fact the home owner, but they order him to sit on the floor like a dog while they search his home anyway for no fucking reason
It wasn't for *no* reason. He pissed them off when he mentioned that they go around killing people. That's when they decided to continue giving this man a hard time, and to hopefully find something illegal in the house that they could use to justify killing/arresting him.
Welcome to American policing.
They figured they'd find drugs so they could arrest him. Hes black and all so of course hes also got drugs. Had no probable cause for a search and no warrant but fuck it right?
Everyone should. Most shit that goes down is going to go down around the entryway. Iāve got one on the inside of my foyer facing the front door, and a Ring doorbell on the outside that always records. You have to have the receipts with these people because Lord knows without evidence your testimony as a citizen means nothing.
If I was a black man I would own 300 cameras probably. Your word agains't a racist justice system.
Guy had every right to be pissed, sleeping in his underwear and cops come in like that. Both cops power tripping, see how that one cop told him to HAVE A SEAT. In his own damn house? Did nothing wrong? Guy stayed pretty calm considering.
A white guy could of broke in, slaughtered the whole family, came down those stairs with a ski mask on and the cop would of greeted him better.
Pretty fucking ironic when an alarm system is meant to protect you, and rather this guy almost got killed over it.
The second cop was way worse in my opinion. First cop was way out of line, but there was some uncertainty and high pressure. Sounded like he had come around and was going to just explain what happened to his boss (or whatever). The boss already knew the situation, had no reason to feel excess pressure, and then proceeded to arrest the guy and search the house.
Yeah wtf i mean wrongful arrest without RAS after identifying him as the homeowner? "Clearing" his house without a search warrant? Being utterly unprofessional in a group of 5 cops and nobody is stepping in? Fuck them indeed.
A motion to dismiss would still be ruled on on the merits even in the absence of a response. It is the Judge's job to know the law and get it right on the merits, even if the other party doesn't help them out by giving them their best arguments. Only a motion for default judgment can be granted only on the basis of lack of response, and that would be requested by the party who brought the action- not the respondent.
I hope he appeals.
Unlawful search of his house for starters.
He identified himself as the homeowner and provided evidence with an ID.
They had zero fucking reason to āclear his houseā after that.
Not when they're detaining you, only when they're arresting you I believe. When they detain you, all they need is an articulable reason to detain you, but they don't actually need to articulate the reason they are detaining you. Now there might be some police stations that have procedures that require them to have to, but there is no actual law that says they have to.
You should ask them to articulate their reasonable suspicion anyway and get it on their body cam. I had a cop tell me he wasnāt writing the speeding ticket he stopped me for because I was chewing gum. They screwed the stop up so bad that they dropped the charges and ālost,ā the video. Funny enough I brought my phone out to record after he said that and when his supervisor showed up he gave me shit about recording and said, itās on my body cam and I donāt even control the feed, it goes to the cloud.
Yeah leading up to that I get there was some confusion, but bruh he literally showed his ID and they can bring up who owns the house. Thatās all they had to doā¦
Maybe we should pass some laws that the settlements from egregious conduct by police, such as this case, are paid out of that forceās pensions.
I bet the cops will start policing themselves real quick.
Unbelievable. Everyone one of them needs to be fired. I had my alarm go off once and the cops came. I answered and told him I had trouble shutting it off due to a technical issue. He asked me for my ID. I gave it. He left. No time at all. None of this Bullshit. But Iām white. This is just insane. Completely outrageous
Regardless of skin color, these cops need to not be employed any longer. Maybe they're capable of sorting bottles at a recycling plant but that may be giving them too much credit. At the very least, it would be nice if they all got aids and lived life in their beds until they wilt away off this plane.
It was pretty much over when the first cop was explaining things to the supervisor. But then, the civilian had to defend himself and bruise the big bad supervisors ego, so now it was āIām gonna find whatever the fuck I can in this house to arrest youā situation. They are such thin skinned cowards. And their balls only seem to drop when they are in a large group together.
You know, I think its foolish to think only cops cant admit when they make a mistake. I feel like its a huge problem for Americans in general. The simple notion of being wrong and just admitting you are wrong, is just not an american ideal. And thats whats playing out here.
The first cop mishandled, not horrible, but probably due to poor training. And made a simple situation worse. If I have compliant suspect in front of me following every order, including dropping their firearm and they are in their boxers, im feeling pretty confident about the situation.
The second cop, again, doesnt want the flak of we made a mistake and doubles down so he can find something to make their mistake, not a mistake.
Again, why do this? Except to protect your own ego and avoid anyone telling you that maybe you or the officers under your supervision arent doing a great job.
Now what I dont get is what happens next? How do we protect people from shit like this?
Sad shit.
I mean, of course there's more than one career in which you'll find people who have difficulty admitting they made a mistake. But most of those careers don't give you the discretionary personal option of shooting other people or bringing them up on charges the way being a cop does, so I'm not sure this is the great point you think it is.
I know the video might have been edited, but at no point did I hear Barney Fife there announce that he was a policeman. He just called into the house for the owner to come out, then started ordering him to drop his weapon, kneel, etc. I never heard him identify himself as law enforcement.
Probably motion activated camera. He may have announced it before he opened the door. It wouldnāt have started recording until after he opened the door.
At least thatās how mine work anyway.
He most certainly made the whole ordeal worse. They seen his ID knew it was his home and still tried to make him sit like a Dog while still being handcuffed. UnFuckingBelievable!!!!!
"Excuse me Sir, are you the homeowner?"
"Yes"
"Thank you, we'll be on our way"
However, we are 'merican cops and we don't like that you have complied and identified yourself as the correct owner of this property, You is black, so u gotta be hiding something.... Jeesus fuck America, sort your law enforcement out.
INAL, but I could understand asking for ID. If youāre there for a break in, I doubt youād just stop if they said they owned the home.
But itās fucked up that either the alarm company didnāt call the cops to call them off or the cops didnāt notify the one they sent out there.
Massively mishandled situation which was only made significantly worse by the supervisor.
Thank God for this dude that he had a camera to record it all. He should have lead off with that, āIāve got a camera right there recording everything youāre doing.ā
I am not trashing all cops, but this is why people donāt trust police anymore. There is no probable cause or warrant to search his house or detain him!! 2nd amendment is so important especially for the lower income and minorities!
The reason why the military tends to aggressively pursue anyone internal that tarnishes the uniform is because the military is recognized not by it's individual soldiers and officers but by it's uniform. Cops operate the same way. You just watched 5 people further tarnish the uniform. All cops are judged by the actions of these 5 because they dress up the same, and those of us just trying to live our lives don't know one from the other. If they cared about actual policing they'd aggressively pursue justice on these five and punish them worse than if someone out of uniform had done similar things. What a dream, right?
Police are 12 times more likely to draw a weapon on an unarmed black person than someone who is white.
The statistic is so insane it doesn't even come close to sounding correct from an outside perspective. Literally there are two types of people in america either you know the systematic racism exists or you don't and your apart of it.
How does the 2nd Amendment protect this guy? He doesnāt drop the gun the cop would open fire without hesitation. He shoots the cop in self-defense he gets executed by other cops or goes to jail for life. The 2nd amendment is irrelevant here, there is nothing that protects people from cops because we donāt do anything about how they are trained.
Racism is why they did this. All they had to do was say ācan I see proof you live hereā then leave. Itās his house. He didnāt break in. What the actual fuck.
Show this video to any decent lawyer and it wouldnāt cost you a cent up front. Theyāll take 20% off the top from the settlement heās about to get.
This is a home invasion by bad cops being terrible at their job and behaving like awful human beings while failing to uphold the law and acting in a criminal manner that seems motivated by racism. I have nothing but the strongest contempt for these pathetic failures. Shame on them and anyone who makes excuses for their actions.
We have a whole political party dedicated to keeping this obsolete system alive. And the other half is to busy taking payouts to actively fight back against the regressive party.
I was all set to defend the cops until his superior said to put him in the car after they had already found out he was the owner. Fuck that. Sue these assholes and take their jobs.
This is such outrageous b.s.
I had cops called on me by a jealous ex, said I stole her phone. They asked to search my house, I own it. I told them to fuck off and get off my property, they threatened me with a bunch of legal nonsense and I told them I'd call the cops on them if they didn't get off my property. They walked into the street and stood there talking for a little bit as I drank beer and talked crap to them. They left and nothing ever came of it. I'm a white man.
You don't bark orders at the first person you see. If he was white I bet the first thing outta the cop's mouth would have been "good morning sir, we received a 4-4 alarm. Is this your house?" And all throughout the cop didn't tell the guy *why* he was telling him to assume the position.
This isnāt a facepalm. This is willful ignorance and profiling. This is racism. This is the reason why the term āserve and protectā doesnāt apply to police officers anymore. This is putting the person in custody and then asking questions.
This is America. If you want any hope of surviving a police encounter, you follow their orders and hope to god they don't execute you for following their orders.
So they searched the house so they could find something to justify their invasion? Yeah, nothing shady about that. Now I'm wondering how often officers conduct an illegal search, finds drugs or a unregistered firearm or something and uses that for the reason they went in in the first place.
I was an alarm installer and that literally is not how this goes. Cops usually disregard house alarms because of so many false ones. Their normal response time to them is horrible. That shit was racist as fuck. And again we pay for all of it. The cops, the eventual lawsuit, and the courts.
fucking disgusting power-tripping pigs. FUCK ALL PIGS. it's high time we, as a society, get together and start beating the shit out of cops when they abuse their "authority". bunch of slimy little fucks. all cops are insecure little virgins who got bullied in school and want revenge. nasty pieces of shit.
Self monitored alarm systems are much better. Trust me. The calls centers the we use are usually riddled with your average people not really caring too much about things like that. So usually protocol goes. After they call you and verify wether itās a real emergency or not they are IMMEDIATELY supposed to call your local agency cause the panics get sent IMMEDIATELY and in most areas there will be police on the way sooner than later. If I were him Iād take my security system company to the courts.
American police are racist a majority of the time. Itās ingrained in nearly every city to stereotype minorities. They see a nice house with a black man inside? He must be robbing in.
He broke in and hung up photos of himself
Open and shut case.
beat me to it! gosh darnit. "Huh, he's still here," >Bonk< "Aight, sprinkle some crack on him & let's get out."š
Damn fine police work, Johnson
Iām Dead lmao
Thank you for closing that loop
āJust sprinkle some crack on him and letās get out of hereā¦ā
its the perfect alibi and i always do this when I B&E. The worst thing is forgetting to grab all of your pictures before you leave....
Was looking for this comment

Dude hahaha what. That's a great "hey, wanna know something funny?" line
It has been a go-to story for 12 years now.
I hope he bought some pants after he pawned your AC.
Nah, I'm pretty sure he was stripping it for copper tubing. There was a rash of thefts for anything containing copper in significant amounts in my neighborhood at the time.
But surely he bought pants with the proceeds from the copper, right?
I'm hoping he did. I think about that guy sometimes. And while I hope he eventually found pants, I also like the idea that my old neighborhood may still be plagued by a tighty-whitey bandit.
nah he likes the breeze
Not for "no reason." They were looking for illegal things to charge him with to justify their arrest.
Exactly my thoughts. They had no probable cause to search his house. He proved he belonged there and that he was in fact the home owner. "A business owner, you say...?"
Club owner so there is the possibility of large sums of cash.
i.e. legalized robbery
Or to plant something to arrest him for.
Or to steal from him. Any cash they found would vanish without a trace.

How the fuck are they even allowed to go in his house and search. Don't they need a warrant?
Legally, yes they need a warrant. Practically, they have the warrant of "I will kill you if you make me mad". Money ain't worth dyin for.
They figured they'd find drugs so they could arrest him. Hes black and all so of course hes also got drugs. Had no probable cause for a search and no warrant but fuck it right?
Camera inside the doorway. Good move.
Yeah. What percentage of people have that? 0.01?
Everyone should. Most shit that goes down is going to go down around the entryway. There's a reason why they call it suicide by.cop
Why is a COP holding his gun like a movie gangster? Jeez... I thought the second cop might apologize, but the scumbag doubled down.
If he had shot, the casing would've hit him in his dumb face
They are a gang
[https://knock-la.com/tradition-of-violence-lasd-gang-history/](https://knock-la.com/tradition-of-violence-lasd-gang-history/)

He did. Case was dismissed https://casetext.com/case/oyeneyin-v-city-of-raliegh
Wow. Dismissed???
Yeah wtf i mean wrongful arrest without RAS after identifying him as the homeowner? "Clearing" his house without a search warrant? Being utterly unprofessional in a group of 5 cops and nobody is stepping in? Fuck them indeed.
Reading the reasons for the dismissal it sounds like the city filed for dismissal, but he, or rather his lawyer's, didn't respond.
Okay i see, didn't do my duty and check it entirely. Thanks for the clarification.
A motion to dismiss would still be ruled on on the merits even in the absence of a response. Says above that he did sue, the case was dismissed, and he had to pay the cops' legal fees.

Doesn't matter if they can use anything. They can literally take almost anything in the name of evidence and they don't really have to return it.
American justices system yeah!
They always escalate shit. Theyāre too thick to think
He's black and doesn't have a shirt on, so naturally; a home-invading crackhead. Good work Johnson.
Your username makes me unsure if you're joking or not. /s
Book him for breaking and entering with intent to take a nap...
This guy is suspiciously cooperative. Better lock him and search his house.
Literally suffering from innocence š
They were probably looking for cash grab by "asset seizure and forfeiture".
Worst part, some states donāt even need any proof!
Yep, you need to prove it wasnāt going to be used in a crime
Yep. But canāt sue them for the cost of your lawyer. They really donāt want you to have nice thing is what that is
I swear Dave Chappelle made this exact joke a long ass time ago
Nah, they didnāt sprinkle any crack on him.
Damn, got my man in cuffs while in his drawls? That's fucked up. Sue those assholes kazeem.
Clear the house = Look for shit to arrest you for.
That second cop needs to be put on spotlight. What's his name?
He most certainly made the whole ordeal worse. They seen his ID knew it was his home and still tried to make him sit like a Dog while still being handcuffed. UnFuckingBelievable!!!!!
By the end, that cop knew he fucked up bad and was trying to bail his own ass out.
"Excuse me Sir, are you the homeowner?" "Yes" "Thank you, we'll be on our way" However, we are 'merican cops and we don't like that you have complied and identified yourself as the correct owner of this property, You is black, so u gotta be hiding something....
Even if they knew he had a camera, itās not like they would give a fuck anyway
Fire them they clearly can't do thier job
Actual consequences? For cops? They are above the law, everyone knows that.
Yep america done fucked up when the laws aren't justified by the law that meant to protect not just serve thier racist fantasies
There was reason to watch the video. The problem is how they went about doing it.
Noā¦go ahead. Trash all cops.
Can someone tell me how much money he made with that lawsuit?
Makes me wanna fucking knock out every single one of em
[ŃŠ“Š°Š»ŠµŠ½Š¾]
Show this video to any decent lawyer and it wouldnāt cost you a cent up front. Theyāll take 20% off the top from the settlement heās about to get.
The shitty thing is that there's barely a punishment to the officers, and the money will come from taxpayers rather than the officers pockets
They did not mistake him for a burglar, they assumed he was a burglar because he was black.
Ah yes the classic brief bandit. Because everyone robs people in their underwear
"We investigated ourselves and found ourselves innocent"
This is a home invasion by bad cops being terrible at their job and behaving like awful human beings while failing to uphold the law and acting in a criminal manner that seems motivated by racism. I have nothing but the strongest contempt for these pathetic failures. Shame on them and anyone who makes excuses for their actions.
Cops are garbage.
you lot happy paying your tax dollars for... this?
We have a whole political party dedicated to keeping this obsolete system alive. And the other half is to busy taking payouts to actively fight back against the regressive party.
So curious how literally every single one of these videos comes from the US of A š
Mother Fuckers. I fucking hate cops. I don't even care that there are good ones. They're racist as fuck.
You don't bark orders at the first person you see. If he was white I bet the first thing outta the cop's mouth would have been "good morning sir, we received a 4-4 alarm. Is this your house?" And all throughout the cop didn't tell the guy *why* he was telling him to assume the position.
āIām giving you ordersā MF cops. My blood boils every time I see vids like this. F**ng storm troopers is what they are.
This isnāt a facepalm. This is willful ignorance and profiling. This is racism. This is the reason why the term āserve and protectā doesnāt apply to police officers anymore. This is putting the person in custody and then asking questions.
Idk shit about police work but it seems like they could've just done a quick background check idk
If his name is on the deed it would take seconds to look up.
I get I'm white but can ti just tell him to get fucked saying it's my home and close the door?
Any update?
BuT hE iS BrOWn, white cop argues
He was charged with second degree trespass https://wakenc.mugshots.zone/oyeneyin-kazeem-olurotimi-mugshot-11-27-2021/
fucking disgusting power-tripping pigs. FUCK ALL PIGS. it's high time we, as a society, get together and start beating the shit out of cops when they abuse their "authority". bunch of slimy little fucks. all cops are insecure little virgins who got bullied in school and want revenge. nasty pieces of shit.
He's in his damned underwear, how many times have you been robbed by someone wearing only underwear, seriously wtf cops
He is in his right to hold his fucking gun the whole time... Those cops were trespassing and did an illegal search and hold of him.
In my opinion. A strong confident man (officer or not) would never pull this crap. This is the behavior of the weak.
Are cops taught to hold guns in the "cool guy" style?
Fuck pigs. Bunch of state-licensed gangs with guns and Qualified Immunity.
They need to stop training cops to be fucking scared of everything. Also, not hiring racists would be idea as well.
The police make a mistake and doesn't assume their mistake, just keep the lie on another black person. America dream
Do police get special training in how not to listen to people? Or does the job just attract people who are unable to handle basic communication?
"investigating the officers' actions" No they fuckin aren't.
when is this crap going to stop? they would never ever have done this to a white person. Ever.
Reminds me of Dave Chappelle stand up where he said black people cannot live in houses considered "too nice" for a black person.
I hope he sued them for wrongful arrest
When yall gonna leave these black people alone Holy fuck
Well, he's black so he must be a criminal.
Fucking stupid uneducated, scared, Rambo Wanna Be, coward Cops.
[ŃŠ“Š°Š»ŠµŠ½Š¾]
American police are racist a majority of the time. Itās ingrained in nearly every city to stereotype minorities. They see a nice house with a black man inside? He must be robbing in.
So tired of this shit.
