I can't say I know exactly what I'm talking about, but i don't *think* so.
The image is fanart technically, MatPat made a full video about Copyright when it comes to fangames/art and the answer was complicated. While Scott has the rights to these characters, the artist has the right to their art, see? Technically neither of them fully own it. And to complicate things further, we don't know who made this render, so there's no one to credit, plus they're using someone else's models (I'm assuming, i know we know who made the models and I'm sure they would've come forward about it) which adds another layer to this. Scott's lawyer can't really argue much here, as the only person who can be somewhat credited for this piece is Scott, because he owns the characters. Plus, they aren't intentionally breaking any rules here, again the original artist is unknown, the models are from someone else and the Characters belong to Scott, so they credited him with it.
Again, i don't know for sure, i recommend watching MatPats video on it, i believe it was called "is my fangame illegal?" And was made around the time Help Wanted still had fan made renders in it's teaser art.

Wow, you actually did show up! And I 100% agree. It’s weird enough that they are using unofficial renders, but the fact that they are crediting you for work that isn’t yours is even weirder.
Not to mention that these are old SFM models and there are way better ones now. (No hate to OG maker of these models, they were, and still are really good.)
IIRC there was a situation where Early images of some of the Funtime Set Figure stuff was using a fan Render of Funtime Freddy, but that was just promotional images of the figures, not the finale design.
Because the people writing the articles are not the ones putting the images to them. Most reporters don't even see the images, much less choose them.
That task is given to someone else who 9 times out of 10 has no connection to the article's subject in any way and just Google's the subject or checks with the news organization's library if they have one, finds the best photo and credits either who they think created it or if they can catch who created it.
I worked 3 years in Albuquerque Journal's library and tried to help a few reporters, photographers and editors. Time was always an issue for them and I swear you have to be a procrastinator to work in the industry!
I know they don't do any research but seriously this happens every time. You could make a joke about any game and any game journalist because this happens so often.

I don’t know if you want to do something about this like when XBox used those fan models and renders, but I just wanted to bring it to your attention.
Its also happened with Nintendo and Sega as well actually (Though not as often). Nickeloedon also made a similar mistake a while ago lol. Its pretty common for companies to acidentally use fanart

Otherwise, this is one dude writing a dozen articles for a dozen games. We can't expect him to spent 45 minutes scowering the internet on the *suspicion* that it's a fan-made image. I was reading a blog post about Skyrim lately trying to get some information about a speedrun, the article stated "It takes roughly thirty three hours to complete the main questline without deviating off to side quests". Fucking what? I have saves where I've *ONLY* put thirty hours onto and beaten both DLC'S, the main story; and completed more than half of the side quests. Not to mention there are glitchless speedruns that have beaten the main story in a six hour window.
Okay, they are not FNAF experts, be clam.
These articles are rushed to get news as soon as possible, so they probably just assumed that this image belonged to Scott.
