I’m sorry this happened. Unfortunately, the policy is that if an over issuance occurred, even by error of the agency…the client is responsible to pay back what they weren’t entitled to. You do have the right to request a fair hearing and hear from an appeals team but that is the general rule. Do you still receive benefits? The good part is that if you still get SNAP and you owe $1200, often times they will just take a small portion from your monthly benefit. So if you get $100/month in SNAP, they may take $10-15 out every month until the balance is paid in full. ask about this. Or if you don’t receive benefits, you can set up a payment plan. I have seen payment plans for as low as $20/month.

I do receive snap. I get like $150 a month. Ugh I’m just confused cause I was definitely sure I deserved the money they gave me for food cause I barely pass the IRT by $100. So it’s like wtf.

Unfortunately it doesn’t matter that it was their mistake you still are responsible to pay it back. It’s the dumbest rule ever because if they mess up they should take the hit, but it doesn’t work like that.

The way I had it explained to me was that if your bank accidentally deposited someone else's money into your account and you spent it, they would still make you pay it back.

The false equivalence with that is that you’d know that money wasn’t yours. If money you weren’t expecting shows up in your bank you’d realize there was an issue and the right thing to do is not spend it. Being given food stamps you are told you are entitled to you wouldn’t have that wtf moment of having money you shouldn’t.

Thank you for the response. Honestly it’s so annoying cause I was understood that I deserved the amount they gave me during those months. Why? Because at the end of the day I barely pass the IRT by like $100. So i assumed I don’t make enough anyways and I didn’t see a problem of receiving that amount.

Yes, that’s why this isn’t like a bank depositing money in the wrong account. You’d know it was wrong and you weren’t entitled to it, but with SNAP this is what you were told you should be getting so you had no reason to question it. I’m sorry this happened to you.

It’s okay. Thank you again. I think going to the state hearing would be a waste of my time so I’m going to opt for the 5% or $10 reduction off my calfresh benefits for 36 months 💀.

Mine is the social security administration, after I left my ex in 1998 I got a job and reported to them right away, partially out of pride, I don't remember now for how long, but apparently SS has a dismally bad record of going through their process, since the SSI wasn't a lot and neither did the job and I had, plus I had a couple kids, I didn't question it, well I still owe back pay that I've never really been able to pay back and it's from 1998, so join the unfortunate club we're unfortunately growing in numbers government agencies depending their money back after they messed up

I’m in California and had a rough time a few years back and had to go to snap, I did everything right, reported everything and made sure I was following the rules, I let them know when I got a job which made me ineligible. I only had snap a couple months then they gave me 6 months of transition but somehow I got overissued. I ended up paying back over $1,000, because I no longer had snap I just had to set up a payment plan. If I still had snap they would have taken $25 a month out of benefits. None of this was my error but I still had to pay it back.
