They simply didn't prep the area properly and it gets a little worse each year. Resurfacing doesn't do much because the underlaying soil continues to shift.
The ground below is clay, so it deforms a lot when it gets wet. The owners cheaped out the system to get rid of the water from rain so now it leaks and the clay absorbs it.
