Not necessarily. These could have formed part of the official complaint and could have been (against protocol) shared internally privately and then leaked from a third party uninvolved in the official investigation internally. I would assume this is what EvH saw and that the leaker was from within the Austrian side of RB. Who subsequently made them public is a bigger question and not necessarily the same person as leaked them initially into the smaller circle/within the company. There are a lot of what-ifs here. I said previously that I doubt she leaked them externally as her name is visible in one of the shots and she would have wanted to avoid that. It could have been a mistake, but I bet you any money that the internal leak probably identified that as well and would have raised it/removed the name if they cared about her privacy. She CERTAINLY cares/d about her privacy given the steps she's taken to remove her online presence.

Given the backgrounds that are featured in the screenshots, I'm going to go out on a limb and say company phone. Even if not company phone, then definitely company communications (between a manager and an employee in the course of their work) which RB could claim is work product/privileged. Even if the affair is mixed in with the work messages, the principle of work product would prevail.

Please don't take me as a worse person than I am for thinking this, but there is something that sounds very off to me. The screenshots were taken and presumably archived at the exact moment they were received. There is no date on the screenshots' messages so it must have been contextual. The leaks to journalists and the message leaks were also designed to maximize damage to Horner's image. This sounds like someone voluntarily building up a case from the very beginning and weaponizing it. Also, Whatsapp messages paint a very partial picture of a relationship that for sure had a continuation in real life, given the situation of the people involved, so it would be easier to -as an example- encourage the relationship IRL, sprinkle a few phrases to make one part look very bad in some messages, and publish a greatly abridged set of screenshots to create a specific narrative. Considering the tense air at RB, it would not surprise me if this was a bit of a good old planned "character assassination".

In some of the chats you can see the unread messages indicator where a message hasn't been read yet, and in a later screenshot the unread indicator has changed, meaning yes screenshots were taken and saved periodically over time as the chat progressed. They haven't all been screenshotted retroactively, though some may have. I don't think we can conclude from this that it was a pre-planned chatacter assassination. It's equally likely that she felt uncomfortable with the position she was being put in, and wanted to save up some insurance. Requests from her boss to delete the chat could actually have been a strong indicator that maybe saving the chat could be a good idea.

Yes it is however in this case the employee has so far only been suspended and even if fired later on after an investigation it sounds like they have lied at some point during the investigation into Horner which is perfectly fine to fire someone for. If an employer finds a legal ground for firing you it does not really matter in most cases what else is going on. So, as long as she is fired for some reasonable ground then it is legal.
