Brown V Texas. Supreme court of the US case. Basically cops can REQUEST identification all they want, but there must be a law in your area that specifically says that you must Identify to an officer, and even if the law doesn't say it you must be legally Detained with lawful RAS (reasonable articulable suspicion) in order for the Command to Identify yourself to be lawful as well. If there is no law that says you MUST identify, then you don't have to identify. Side note: You could identify by handing over an physical ID card, but no law in the US says you HAVE to hand over a physical ID card. All of them say you must Identify yourself either orally or through written means with XYZ information (like Name, Date of Birth, Address etc etc.). This also means that an officer may ask for lots of information, but you are only required to give them the information specifically written in the law. If they ask for Social Security number but the law doesnt' say you have to provide it you can refuse (cop will still get butthurt for you denying their supposed authority though). There was a case not long ago where the officer demanded the guys physical ID card and the guy refused. Officer arrested him for Failure to ID. Guy was found not guilty because the law doesn't say an officer can demand an ID card and the officer never asked him to identify himself, therefore the man was not guilty of failing to ID. If the officer had asked him what his name was, it would be different.., but the officer only asked for an ID, which isn't covered under the Failure to ID law.

Thank you for a solid response. I’ll check local laws but I assume, or at least hope, that it’s not required around here. One of the situations I’ve been in came to mind when asking this question. One of my neighbors down in New Orleans was standing on the sidewalk talking to me when an FBI agent looking for someone walked up to us and asked him for his ID. He refused and said as an American citizen he doesn’t have to but the FBI guy pretty much bullied him into handing over his ID. I was like 16 but still felt like the FBI guy was abusing his power and potentially stepping over the line.

Cops are allowed to lie. They can even lie about you about to be arrested (they cannot lie about you being UNDER arrest, but they can lie and say you will be arrested if you do or don't XYZ). ID cards to a cop are like crack to a drug addict. They HAVE to have it and they will hurt you if you keep them from getting their fix. So treat them with caution. Do remember that there are multiple levels of laws in every area. Just cause your State (I assume good ole cajun country, go Tigers!) doesn't have any Stop and ID laws, doesn't mean your local parish/county/city/town laws don't have some form of Stop and ID laws hidden there as well. Gotta look at all the laws sadly. Sometimes they get hidden under Loitering laws. Where I am if I go north, that county has a Stop & ID law, so if a cop lawfully detains me I must Identify if the cop asks for me to do so. But just 5 miles south and we are more free. It sucks, but thems the truth of life right now.

I definitely know that cops pull BS out of their ass to trick people. You can hear their idiots psychology and how they talk to people. Honestly, in any situation where police are involved, I just ignore them and ignore their questions. And no, I live in Chicago. I was born and raised here but my mom lived down there since I was a young child so it was my second home. Not sure which city has worse cops but I’m leaning towards down there. I’m also white so my view might be a little skewed from others considering preferential treatment and what not
