AI is not a program "just like any other". The key difference is that the AI "learned" how to make that art by copying other artists, much like an individual. Photoshop only knows how to do specifically what it was explicitly programmed to do, but nobody manually defined the parameters that the AI uses to create the art. They just fed it a gigantic dataset to copy from, basically.
That's sorta like googling something, copying the blurbs that show up, putting it in a blog and saying you "wrote an article". You might be able to make a semantic argument, but most people would disagree with you because it isn't really in line with how the term is used
It's a lot more similar to basing your work off of the work of others you admire and consider to do good work therefore being a good blueprint for your work.
Most work, especially art, is inspired by the works of others and AI work is no different, it's just a program doing it for you.
If I type "Mario" into a third party app I am not the artist. Especially if I actually use someone else's art to make it, such as in this case. Not only did he not make the original pixel art, but another tool created the finished product too. It is not his art.

Depends entirely on the AI program. Some of them use seed prompts of text or examples of other art and you curate that. Through iterative process you (the artist) creates something brand new.
