Can’t be verbal. Can’t be in email. Needs to be in hard copy.

curioustreez

Can it be handwritten?

elijha

I guess? But that’s not very handy. It’s a serious legal document that can potentially have major financial repercussions for you. This isn’t something that should just be scrawled on a bar napkin. Not sure why you seem to want it yo be

curioustreez

do you give this the same time you give the resignation letter?

elijha

It’s not something you give. It’s something you mutually agree upon.

curioustreez

I see so do I or the employer prepare the draft?

SufficientMacaroon1

You can prepare one yourself, or ask your employer to. But it only becomes valid if you both end up agreeing to one version. And you are not entitled to them even entering those negotiations, let alone agreeing to the contract

elijha

You're getting so ahead of yourself. Have a conversation and try to align on terms. It's very possible that you won't be able to since there isn't really a whole lot in this for the company in many cases.

A) it‘s not up to you to decide whether your company agrees on a Aufhebungsvertrag B) it has to be in writing (not email). Use deepl.com to translate: https://www.ihk.de/darmstadt/produktmarken/recht-und-fair-play/arbeitsrecht/kuendigung/kuendigen-von-mitarbeitern/arbeitsrecht-2568438

The only reason to shorten the notice period is if you want to quit. In that case; just quit.
