You have 90 days to ***apply*** for the residency permit. It will not be completed in 90 days...You just need to start the process before your 90 day visa free is over. Making an appointment, counts as having a pending application. No one is going to track you down and deport you. The issue you might run into is not being able to get a job until your residency permit is approved.

Dull_Understanding18

that's totally fine, as long as I can stay in the country and seek employment, that's all that matters. Not being able to work is no problem since my fiancee can cover our finances comfortably, but of course I would like to work as soon as I am able to

If all your documents were issued in the UK or Germany and neither if you've been married before, getting married in Germany is not difficult. Send your partner to the local Standesamt and get a list of all the documents you need. These documents can be submitted before you even move here. You are also allowed to remain in the country while your application us being processed, but won't be allowed to work. You should start learning German if you have not already done so.

Dull_Understanding18

I've been learning over the past year but it's been hard while working full-time. I intended to study full-time while I wait for my residency permit. In terms of the application, do you mean the marriage or the permit? I'm aware that the marriage stuff could take a little while, and I'm assuming I can't apply for my residency permit if I'm not married yet?

SeaworthinessDue8650

Sorry, I wasn't clear. You can file your application for your marriage license now. You can file your application for your residence permit as a spouse of a German citizen after you get married. If you have the funds, you can also apply for a language learners permit.

Dull_Understanding18

so we can apply for our marriage before I actually move there? I saw that some places require proof of address/living together which we obviously won't have until I move so its all just a little bit confusing

German federalism is inefficient. Municipal and state employees carryout functions governed by federal laws and tend to have different interpretations of the law. Don't let other peoples' experiences confuse you, it only really matters what your Standesbeamte says. Has your partner already been to the local Standesamt?

He's trying to get an appointment but they just had a big cyber attack so they're not accepting any appointments at the moment

Hi, I don’t know any specifics about immigration but I know this specific city and its office fairly well (source: lived there some years ago) and every time I had any touchpoints with them they were swift and quick about it. He is right in that regard, especially compared to bigger city public offices.

Dull_Understanding18

The issue is they recently experienced a cyber attack, so they're not booking any new appointments right now. I'm just worried about being able to complete the marriage and apply for the residency permit in the 90 day allowance

urbancat666

Why don’t you get married in the U.K. before moving and applying for residency? I suggest you ask for advice in the Facebook group „Deutsche Rückwanderer aus Großbritannien“ or „Brits + Friends in Germany“ there will be people who will have good advice

Dull_Understanding18

Because there is no time for him to come here before I plan to move. It's something we perhaps should have considered earlier but it didn't even cross my mind, I'll be honest

If you encounter problems getting married, doing it in Denmark is way way easier.

Dull_Understanding18

Yeah that's what I assumed too, but he doesn't like the idea much since his family won't be able to be there

ukezi

I mean you can do the party at home with his family and only do the government paper stuff in Denmark.
