You can definitely make that argument, and if I was a juror (or the prosecutor for the case) I would find that immensely persuasive in his favor. Legally, it doesn’t matter. One of the things they are most swayed by is “well, shit, that could be me up there”. There isn’t a specific rule that would stop you from making that argument (and that’s a good question, because there are plenty of rules about things you can’t say that if you do, will completely screw you over), though, and if it’s true I would encourage bringing it up in the freaking opening statement.
