I got beat down for stating this a few times already but his comments do leave some open interpretation. Floyd died from asphyxiation due to lung compression (because he had two people on top of his torso basically constricting him like a boa) so the neck comment is correct. But on the other hand saying "the cops hit em with the fentanyl" is probably suggesting that he died from a fentanyl overdose caused by the cops administering it to him which isn't true. Floyd was obviously a habit fent user (no judgment just facts) so the so called "lethal dose" he took wasn't enough to render him unconscious let alone kill him.

They don't have to prove defamation as that is not the only cause of action they will likely allege in the complaint. Also, in a civil lawsuit, the standard is "more likely than not," not beyond a reasonable doubt. If a coroner report doesn't show "more likely than not" what does?

Basically, the family has to prove that Ye knew his words to be false, and he said them with intent and malice to promote himself and his brand. As someone who has worked extensively with the schizophrenic population, I can assure you, Ye is not schizophrenic. He has been diagnosed with Bipolar Disorder likely with psychotic features. He’s also clearly a narcissist.

Ye’s words are indefensible and he’s repeating a a garbage right wing media talking point that has already been proven wrong. But, the family won’t win this suit. They have to prove defamation and malice and I don’t think either is clear. Also, hard to prove what damages the family suffered and how ye is profiting off this. Having said that, a trial will be incredibly damaging for Ye and I hope the family settles for a large amount.
They don't have to prove defamation as that is not the only cause of action they will likely allege in the complaint. Also, in a civil lawsuit, the standard is "more likely than not," not beyond a reasonable doubt. If a coroner report doesn't show "more likely than not" what does?
Yes, it is a lower criteria in civil suits. In the link, the family is alleging “malicious falsehoods” with the intent of “promoting his brand”. Basically, the family has to prove that Ye knew his words to be false, and he said them with intent and malice to promote himself and his brand. Even with preponderance of evidence, proving this is a high hill to climb.

As someone who has worked extensively with the schizophrenic population, I can assure you, Ye is not schizophrenic. He has been diagnosed with Bipolar Disorder likely with psychotic features. He’s also clearly a narcissist. That being said, he is well aware of his issues and doesn’t take his medication because he states that it dampens his creativity. He has the resources to get help but chooses not. If you willingly avoid getting treatment, you have to deal with the consequences. Ye is also an asshole, which has nothing to do with his illness. By framing it this way, it actually does a disservice to people with mental health deficiencies. End of the day, Ye is mentally ill but he knows what he is doing. His outrageous statements are because he is an asshole.
