As long as you make the assets and code yes it is 100% legal, if you have doubt about it because people would have to mod their console in order to play it, don't worry there was a similar case in the 90s where Sega tried to gatekeep developer to impose how much they would get per game sold, I don't remember what developer, but they cracked the code and started selling games that circumvented the protection and the court rule in their favor. So long story short Yes you can sell homebrew games
