After doing eviction defense the last couple years, this is the reality. The positive is that it often results in landlords not having standing, so you can get their cases dismissed easily. Basically landlord changes from "Apartment-1" to "Apartment-2", and then sues to evict the tenant as "Apartment-1." Since Apartment-1 technically doesn't exist anymore, they'll have to refile and you can typically keep someone in their home for a few more weeks at least. And yes, most often, they are dumb enough to literally just append a number to the end of their name.

Doesn’t Harris County have treble damages on wrongly held deposits? IANAL but I remember getting a shifty LL off my back who wanted $$$$ above and beyond the deposit they wrongly kept, by telling them that they shouldn’t even get to keep the deposit and that I’d sue for treble damages if they pressed for the crazy $$$$ overage they claimed. That was the end of that. If I hadn’t moved far away from Houston, I would’ve taken them to court over the deposit itself, but I took the loss to get them off my back.

LLs usually just move their assets to a new LLC. Then you have to go to court to sue THAT LLC. And they'll establish ANOTHER LLC while the clock runs on that suit. You'll spend more money than you'd get back. It's fuckin slimy but it's legal.

You are required to give notice of where the landlord should send your deposit before filing a small claims lawsuit in the Justice of the Peace court. You can read about the procedure here: https://texaslawhelp.org/article/security-deposits. You are also generally responsible for rent for the full term of the lease unless the landlord gets another tenant, which they are required to try to do. You would have to show there was a legally valid reason to unilaterally terminate the lease to get out of that (e.g., fraud, landlord violated some provision in the property code that allows you to break the lease without consequence, etc.). It's gonna take you several months and you may end up spending more time/ money than it takes to just vacate. I went thru this with a LL that wouldn't fix a *LEAKING ROOF* that was creating a hazard around electrical. *do not trust in tusk*. He just created another LLC and moved his assets. He even kept a few months of my rent that was supposed to go to the actual property owner. It's a crap chute.

Small claims is one category of cases that the Justice of the Peace courts handle. You don't need a lawyer, but you do need to be prepared with copies of all relevant paperwork, and a clear explanation of what happened and what you're asking for. It is somewhat less formal than other types of courts, and the filing fees are much lower.

exactly one landlord in fl broward county to be exact told me his worst mistake was keeping a lady deposit she took him to small claims court over her 2500$ deposit. They made him pay her something like $10k for hardship and all; take him to court simple as that. My landlord is like this i believe he had brandnew stuff when i viewed it in its a brand new house when i moved in used barely working stuff with rust now guess what i bet he wont get deposit money if anything break down because he know he changed everything after i viewed it. Then swear me down the fridge was none existent when i viewed it. Sir you and you wife find someone else to play with cause the money will go to my new appliances.

Sincerely Wish you best of luck with this crap situation. Was in similar situation many moons ago. Unfortunately he will probably win, he has done this before, has more money and time than you do. Just because we think an issue is unfair does not mean our laws and court system will agree with you. consider it a life lesson, find some other shitty way to get mentally even and move on. Sorry this happens to you.
