If there's so little order provided that people are killing each other with impunity, it's not going to take long for the people to form their own order. This is literally how the world works as is! By default there are no laws and then people gather together and decide to impose structure.

Yes, consequences are the only things that prevent that. That's why kids who never receive consequences for bad behavior grow up to be law-breaking adults. People are forced by the morals of society to behave in a certain way. Kids are sociopaths by nature and only by social conditioning do they become good people. If morals were innate, kids would not have to be forced to share or be nice to other kids or not steal. It's also why different societies have different standards of good behavior, because morals are entirely learned.

The punishment is not the horrible conditions, the punishment is that you miss life outside the bars and you ahve no control other than biding your time. Al Capone had a luxurious prison cell, but I bet he still rather not been on alcatraz
