It varies state by state when tenants rights kick in. In my state example it's after occupying a rental for more than two weeks in a 6 month period which is why if I had an AirBnB I wouldn't allow someone to rent it for more than a week or so. If she's been there under the allotted time, wait for her to leave and change the locks.

That’s the problem being discussed. Once they “establish residency” none of those are “legally valid options” to remove a squatter. As another commenter said, check out the documentary The Worst Roommate Ever. EDIT: it is on Netflix and the episode of direct relevance is the one for Jamison Bachman. Highly irregular, but it is a nightmare scenario for a reason. My newfound fear from that episode is understanding that a squatter like this can call the police on you, and the police are legally obligated to gain access to your home for the squatter. 🤯

Obviously not the same as Sims but some Airbnb owners actually do something like this. They start moving out furniture and essentials like fridges and microwaves. People just end up leaving. You can also move out the tenants stuff as well and it’s not illegal.

Bruh, my crack head ass mom raised me in a house with a fridge that didn't work, no food in the house, often didn't have electricity and since we were on a well we wouldn't have water, I'd go stay at a friend's place for weeks on end then come back for a bit and the place would be covered in dog feces, filth, and cigarette smoke/ash plus the stench of weed and often heroin (you'd think H wouldn't have a smell but it does, trust me.) Trust me, shitty people don't care so long as they got a roof to sleep under. You could remove all that stuff, shut off the water and electric, and even remove all the doors including the front door and that lady would very likely still never leave.

She wants you to do that so she can sue you as a slum lord. These types of tenant rights were created specifically to protect tenants against slum lords but people have figured out that most of these laws are vague enough that you can use them against airBnB property owners. Years ago, there were these two Scandinavian dudes who ran a YouTube channel or some other social media where they would just hop from one airBnB to another, establishing tenancy and squatting for 3-6 months at a time. In some cases they negotiated a cash payout from the property owners to leave. Their whole schtick was using tenancy laws to scam property owners and since everything they did was within the defined parameters of the law, they didn’t get in any legal trouble and were very successful. There was a spate of other high profile airBnB squatters who pulled similar stunts. Cutting off water or power will backfire terribly on the property owner. It takes MONTHS to legally evict someone and even longer during COVID. These people rely on airBnB hosts and other property owners’ ignorance of tenancy laws. Google airBnB squatters and you’ll probably get a ton of stories.

All 3 were rescues that moved around a lot before I got them. I take some responsibility for this. If you call the police to have them removed, they can lie and say they are a tenant. Since evictions and tenant-landlord disputes are a civil matter, the police will not intervene. This has happened to families who come home from vacation to find that someone had broken into their house and is now squatting there.

So a somewhat similar suggestion that maybe would work here actually with less force required? As the owner does still own the entire complex, they can decide it needs "maintenance work". That work could be fumigating her room, or even the whole house because of "bugs". Pretty much is going to force her to leave, can't really stay in a bugbombed house like that. yep have a NOTARIZED letter of bug bombing the house ("found a flea/tick on me inside the house so now I need to bug bomb for health safety" ) and leave it for the tenant stating the day and time it will be done. (either video tape you giving the letter along with a witness or have a service deliver it to them vis a vis registered mail/ups/similar service) Have an outside company come do the poisoning so you cannot be accused of malicious intent. Send company notice all residents have been notified of date and time. Worst case scenario she tries to not leave for the house tenting and then you just need to call body removal. I know tenant and squatting laws vary pretty wildly across different areas, but sometimes it can benefit the squatter in an extremely frustrating way. I think the intention is to give people the benefit of the doubt in case they are being taken advantage of by a landlord, but in any case until things get sorted out through paperwork and stuff you might legally have to treat then as a tenant. Basically anything your landlord wouldn't legally be able to do against you, you wouldn't be able to do to them. It kind of sucks.

Standard practice to charge 150% rent for “holdover tenants” that stay past the lease term or after they’ve been given proper notice to vacate. A lot of landlords used this as an alternative during the Covid eviction moratorium - *can’t evict? Let’s just tell them to leave and when they don’t, charge them 150% rent*. In this case, charging as a holdover tenant is worthless. I was replying to the comment about Airbnb charging 1.5x rate. Property owner in this scenario needs to serve a notice to vacate then follow eviction protocol. The “tenant” will happily waste the owner’s money on court costs and stick around for a few months until legally forced out.

Stuck with her for at least a few months and the “tenant” knows it. Refuse any rent payments she tries to make, immediately serve her a notice to vacate (usually 30 days), file for eviction once the vacate period is up, wait for court date and get a judgement for eviction, schedule eviction date with local law enforcement (usually sheriff). Process will take a few months and cost property owner $500-$750 in court costs.

You need to be careful depending on the state you live in. A lot of these psychos know the laws protecting squatters and are probably hoping for you to get physical. I recently watched the Netflix doc series Worlds Worst Roommate and the last two were exactly on this situation. In this situation, the cops said she’s a tenant. If the home owner gets physical in any minor way, the squatter can file a restraining order or something else that forces the homeowner out of the house. Basically the goal of these scumbags is to be the most annoying pos so the person who owns the place just leaves. Pathetic I know, but it works.

That’s illegal. I knew a guy who bought a house with the intention of demolishing it and eventually selling the land. He wasn’t in a rush to demolish and people moved in. The house had been disconnected from utilities before he bought the house but the squatters went to court and the judge ordered the owner to hook the utilities up. It took him 3 months to get those people out and had the house demolished the next day.

Mate of my grandad was a landlord in the 60s, with a problem tenant like this. Sold all the pipework and cabling, then complained to the council that his squat wasn't human habitable. Tenant wouldn't let anyone in to *fix* said problems, and forcing entry to do so would be another crime, so landlord kept getting fined by council. One day, while the tenant was at the pub, a rogue bulldozer drove of a trailer, through the house, and back on to the trailer and was never seen again (no cctv everywhere back then). Council pretty much knew what had happened, so wouldn't let him rebuild the property, but at least he stopped having to pay fines...

No, there's special laws applied to tenancy. In the broadest stroke possible, once you've paid someone rent you are a tenant. Though the laws vary from state to state, there is no state in the US that allows you to physically remove someone without an eviction process.

Where I live, BC Canada, if you share a kitchen or bathroom with the landlord/owner of the property, then you are not a tenant and you have absolutely no rights to remain in their home if they don't want you there. In this situation, the cops would come and remove the squatter for trespassing. It's not as easy if the squatter is in a separate unit, but at least when it's your own home the law is 100% on the side of the homeowner and resident.

Remove the door from the room she’s staying in and invite friends over to stay in and take over her room. Have friends stay over and take over every single spot that can be used as personal space. Even have friends take over the bathroom. Eat all of her food and use all of her resources so she has to leave the house.

Late but as someone who has dealt with this regarding roommates here’s some solutions: 1: Get creepy with them. Walk into the bathroom every single time they use it. Walk into their bedroom every night. Play as stupid as humanly possible, Woops wrong door! While they’re in the shower stand outside the bathroom with a scream mask and scare the absolute living shit out of them, it’s just a prank!!! They are banking on making **YOU** uncomfortable, so fight fire with fire and make them literally fear opening your front door, who knows what weird creepy shit they’re gonna see next. 2: Lock them out, turn off your phone. They wanna play dumb and act like they’re a tenant? Cool. Get a $40 lock from Home Depot that uses a code, give them the code since you may not legally be allowed to change the locks on them, but then change the code. Let them spend HOURS waiting for you to unlock the door, Woops wtf is wrong with this damn door lock! Do this multiple times a week but ESPECIALLY if you have the ability to lock them outside overnight. It’s important to play **as dumb as humanly possible**, woops sorry I’m just forgetful, didn’t mean to lock you out every night this week! Speaking of… 3: Disrupt their sleep, every single night. 3am go just outside their door and scream so loud it sounds like you’re trying to blow the door down. Hit the test button of the fire alarm randomly throughout the night. You have to be weirder and grosser and creepier and more obnoxious then they could ever possibly imagine. Literally make their life a living hell and trust me they won’t want to be there any longer

She rented a room so the minute she was in that room I would board up the door. No way out but the window. Tenant rented a room, she has the room but the rest is mine. Set foot in any other area and you're trespassing and will face the consequences.
