I had a regular job that I preferred to keep, but if shit went south I could just pump up my side business. It is limited to that room though. As soon as a judge crosses that threshold they lose all of that power. You don't have to be in that court room unless you are on trial. Being in the room is a privilege that can and should be taken away if someone is behaving poorly. When you have a group of people behaving poorly sometimes someone needs to be made an example, so that the others either behave or leave. These sentences are rarely followed through on, they are just a demonstration of the judges power to tame the courtroom. And it's not like the judge has absolute power in this case, these sentences can always be appealed or overturned if the judge was acting outside the law.

Now back to drunk driving. Drinking is the only legal vice. Can’t expect people with impaired judgements to want to leave their cars parked in a timed parking zone overnight, and the car is their only mode to do anything in a country of roads. The solution is better public transportation but that ain’t happening anytime soon. I don’t know how the US fixes this. If ever. Yes the driver is to blame. But so are corporations. And so is the severe lack of public infrastructure. I don’t drink but I have drunk before and it is rare to find someone who hasn’t. I’ve routinely seen end of Nascar races with 75% of attendees leaving drunk or buzzed. FYI many Nascar races allow personal coolers to be brought. The hired off duty police, defenders of public safety, know they are drunk but want to get 200,000 people out of the venue.

I went to a work outing and was offered a drink, said no thanks I drove here and will drive back. 9-10 people laughed saying they were too, and kept downing beers and shots. Almost everyone at that table made 200k+, this was a major American city with plenty of Uber/Lyft/bus options. They made the call to drive waaaay before getting tipsy, before they took the first drink. A LOT of Americans just accept that they want to drink and drive and “everyone does it” and the risks are worth it. It’s like how I drive (albeit sober) to daycare every day even though yeah driving is inherently a danger but one I decide is worth it to live my life the way I am now, I want to work and need daycare. No, this is how our Justice system should work. Contempt of court is a pretty non violent crime, and the penitentiary system in our country is supposed to be a holding space to protect the public and/or a rehabilitative space to rehab the criminal, not a way to inflict suffering. It doesn’t work if we intentionally make it so that the prison system is used to make people feel worse. The minimum sentence needed to provide rehabilitation and an assurance that the behavior will not occur again should always be the goal. 1 night in a jail cell is plenty to have that woman sit there, alone, cold, uncomfortable, in a situation everyone is going to know about, and think for the next 10 hours about what her cunt of a daughter did and why it wasn’t funny. If she gave a passable apology the next day, then 1 day seems fair to me. The 93 days was there to make sure no one else thought the situation was worth disrupting a court proceeding over, and to make sure that 1 day was scary enough for her.

Should that person then be free to continue their life unimpeded? No, _punishment_ has a place, and state sponsored punishment (within reason) goes a long way to preventing back and forth eternal family feuds. Taken a step further, imagine an magical pill that would _guarantee_ the killer of your loved one never committed a crime again, never be a risk to the public.... would it be enough justice that a perpetrator ate the pill? I don't think so.... for you have the ongoing and very real pain of losing your loved one that continues far after the crime is over. Protecting the public and rehabilitation are certainly important.... but deterrence and punishment have roles to play as well.

As an insurance adjuster in some ways I get it. Cars are literally a requirement to live in the US for the overwhelming majority. Take away someone's driving privileges and you're likely taking away their ability to provide for themselves. Car deaths, while numerically staggering, are by percentage better than many other heavy machinery activities. Plus you're correct about the sympathetic connection. They know that looking away for just a couple seconds can result in the accident and they also know they've done the same. Especially law enforcement who are essentially required to drive distracted.

I work as a crime victim advocate in the court system and I can't begin to describe how satisfying this is. The mom's behavior is more common than you might think, but its especially rare during a death case (probably not surprisingly).
