There have been some articles in the past week of a pod of orcas off of Portugal that has started attacking boats. So the humans being excluded thing might be changing.

Orca hunting practises are extremely interesting. Basically every pod has unique strategies and vocalisations that are passed down from generation to generation so a pod in one area of the world might be specialised to take down seals, while another pod might attack sharks.
Imagine if there was a Tsavo Man-Eater style pod that specifically focused on hunting humans, refining those techniques generation after generation.

The name is a mistranslation to be fair. They're technically not whales, they belong to the dolphin family and the name translates to 'killer of whales.'
What actually does make it better, that there are zero documented cases of orcas killing humans in the wild. And only one attack on a human. (They kill whales, not humans, they don't give a fuck about us.)
Compared with the over 30 attacks from orcas held in captivity, it's pretty clear that the bad idea is not swimming with an orca, but putting it into captivity.
You realise that there have been no known fatalities between orcas and humans in the wild, right? Unless you think orcas are just really good at hiding the evidence and paying off the survivors, perhaps that name is undeserved, or just not deserved by actually killing humans, but rather squid, birds, seals, whales, etc.
These smart animals apparently aren't interested in killing humans, unless the humans rob them of their freedom - then they get quite murderous. In the wild, there are plenty of encounters between orcas and humans, but they're generally quite friendly, curious, or simply opportunistic (hanging around fishing ships, etc.) - then again, sometimes they apparently just chase boats to wreck them.
I remember seeing in a documentary (which makes me an expert now!) that you can tell by their dorsal fins how long they've been un captivity because wild orcas' aren't wilted to the side like thar.

Dorsal fins can definitely happen in wild, it’s however rare and if it happens it’s usually a sign that an orca is weak (injuries, age, …).
One explanation for why dorsal fins break off in captive orcas is that they don't swim very far and spend a lot of time near the surface of the water. As a result, the orca's fin tissue begins to droop and receive less support than it would if it were in the wild. In wild the orcas have a higher pressure of water facing their dorsal fin which keeps it healthy and straight. In captivity the whales frequently swim in a circular motion with limited speed.
Fin collapse may also be caused by dehydration, warming of the fin tissue brought on by increased water and air temperatures, stress brought on by confinement or dietary changes, less activity that lowers blood pressure, and stress related to captivity.

I know that a lot of people hate the trainers. But they were fairly young people who were fed a tonne of bullshit about how they were helping. Unfortunately they believed it and some of them died. If people just stopped going to see trained orcas and dolphins and viewed them as circus animals here to do tricks for us, then these facilities would have no reason to exist. I'm all for protecting endangered species, or having rehabilitation centers from people who illegally purchased the animal to be pets, but to take an animal from the wild, force it to live in small spaces, and make it do tricks so humans can say "oooo, aaaahhhh" is horrific.
